Help needed please,should I be on the new rules???

Hi all, just looking for some advise please,I dont want to go into too much detail in public forum,but heres the jist....to start with I am the Female part of a couple. Here goes,split from hubby in 2000,son lived with hubby,hubby claimed CSA,I payed the amount every month I was told too. Son then came and lived with me in 2008 (feb). I did not go to CSA for money from ex as I didnt want too. However son then went back to live with ex in 2009 (feb). Now he has taken me back to CSA. Heres the question, CSA say Im on the old rules because case originally opened in 2000,however shouldnt the case from hubby of been closed in 2008 when son came to me,and a new case opened in 2009 when son went back to ex. I had alll of sons benefits/tax credits/child benefit etc whilst he lived here,it was all done properly so I can easily prove that the ex should of informed them in 2008 that son was no longer living with him. So im pretty sure it should be a new case from 2008,hence the new rules. Do i have a case???

no I didn't.. but if child lived here was it not ex's responsibility to inform them so they could close case?0

Yes ideally the PWC should have informed the CSA of a change in circumstance, if this wasn't done one would wonder why the CSA wasn't persuing you for money when the child came to live with you. Maybe the PWC got the CSA to just suspend the case rather than close it down altogether and that could be why you are still on the old rules.no I didn't.. but if child lived here was it not ex's responsibility to inform them so they could close case?*SIGH*

Did you have any legal paperwork stating the child came to live with you ? Re read your post so if you were claiming the benefit you should be covered0

dx - csa didnt contact me as they told me a few days ago that i had a nil assesment back in 2003 when the reassed, i dont actually remember this but i continued to pay the money right until son came to live with me.
csa help- yes i have official paperwork that son was living here. Is this enought to get them to put me on the new rules? When i asked why that case wasn't closed they couldn't tell me? Now the 6 million dollar question how do i work out what i will pay on csa1 and csa2?

CS1 is a more complicated formula.Donedoingdebt Lightbulb moment January 2000. Debt at highest approx £102,000. Debt now (October 2009 - absolutely fork all!!!):beer:

The case should definately have been closed when your son came to live with you - I would be pursuing that avenue if I were you. Then you should have a new case from now under the new rules (if you want that).
If you want me to do a new CS1 assessment PM me the details and I will do that - then you can work out which will be more advantageous - as with housing costs, it may be financially better for you to stay on the system you are.0 -

I know you can do old rules assessments having worked for the csa, atleast I think that was the case I read along time ago.
Anyways, is there a website which has an online calcuator to work things out under old rules?When dealing with the CSA its important to note that it is commonly accepted as unfit for purpose, and by default this also means the staff are unfit for purpose.0 -

Look out a Barry Pearson he has one which is ok but you need the allowance rates from that year to work it out.If you can't find it PM me0 -
Just for the record,me and new hubby BOTH get a war disablement pension. So am i right in thinking,if we are on the new rules.....we dont have to pay??? Kellogs,i will mail you soon x0
