Ebuyer, and Incorrectly Advertised Item?

Looking to set up a Wireless Internet Connection.
Purchased this from eBuyer:

In the Product Spec it reads:
"Compatible with BT, AOL, Kingston & all other ISPs"
Now, after receiving this item, opening it and trying it, I find that it is not compatible with all ISP's (Specifically Blueyonder, since they use a Optical Cable rather than ADSL Phoneline Technology.)
Now I know it also says "Supports ADSL/ADSL2/ADSL2+" but the above statement about 'All ISPs' ought to make it work with Blueyonder anyway (They are an ISP right?). I didn't know the difference between ADSL and Cable until researching, and so what happens now?
Am I entitled to a full refund, including postage do you think?
Is this item incorrectly advertised(which is illegal..)? (I'm not out to make a fuss and try to get something for nothing off them, but this is always something to get them moving!)

Note the part "Not Be Used, and As New" - I opened the bags with the Ethernet and USB Cables in - It's no longer new, but they missold the item to me ?!

If you change your mind
If you have simply changed your mind about any item ordered and you wish to return it, then in line with the Distance Selling Regulations (DSR) you can do so provided you inform us of your decision within 10 days of receipt. I think ultimately with this type of product, you need to take responsibility for checking that is will do the job you require. "compatible with all ISP's..." is I would say a rather generalised statement and does not necessarily mean it will work in every situation.
Blueyonder's situation is specific to them and perhaps you need to have checked that your chosen product could be used or supplied with an optical connection - what do Blueyonder supply for connecting? Is there a conversion box you can add between the kit and their cable?
As far as returning it, I would say you have problems proving that the advertising was misleading. The kit is not defective and hence you will rely upon your statutory rights to return it under the Distance Selling regs if you act within the timeframe provided.
The fact that you have opened the box does not mean it is 'used' - just pack it up as well as you can so that you ar returning it as new.

It's worth considering that savings through purchasing online are at the expense of discussing with the retailer your options. You have to know what you are doing and what you need, otherwise it is better to go to a shop and seek advice from a retailer on the various options and what is suitable for your situation. This is often under-estimated and the fact that the retailer has to charge more for this knowledge and service is fair enough.
Wireles products are aften sold as 'one-touch, plug and play, work straiqht out of the box', but frankly I have never found them easy to set up.0 -
As you bought it via mail order you should be able to return it within 7 days any way under the distance selling regs without the need to get into arguements over sales of goods act and item descriptionsAll posts made are simply my own opinions and are neither professional advice nor the opinions of my employers

Are you sure you can't use it with blueyonder? You can't use the built in ADSL modem, obviously, but you should be able to connect your Cable modem to the router via ethernet and still use it as a wireless router0

eBuyer? That company's a joke! I had cause to request a refund for a second set of faulty goods. I had to involve Trading Standards and even they were finding it tough going for a refund. Only after the threat to involve the Small Claims court to eBuyer did I eventually get my money. Beware - their customer service leaves a hell of a lot to be desired!

I have to disagree - I ordered some neon lights from ebuyer that come in packs of 2, of which i ordered 2. One light in one of the packs was broken. I phoned up customer services and next day a new pack arrived via courier
Can't complain at that and have used them ever since
Just goes to show that a few bad reviews doesn't account for the majority

eBuyer seem to be very hit and miss. Personally, I've ordered hundreds of pounds worth of stuff from eBuyer, and only once had a problem which was quickly resolved. But I've heard horror stories from other people.0

ive ordered a fair bit of equipment from ebuyer and ive experienced many problems (e.g. wrong item, item faulty after a few months and next day delivery arriving 3 days late). But eventually it all does get sorted out, the enote system is a joke but their phone is pretty good, tells you your queue number and you get to speak to a real person. I'll continue to order from them until I find somewhere cheaper.ummm...0

Before I had one reponse from you guys, I sent them an email. They have come to collect if from me free. I don't know what will happen from here though. I will seek advice again if I run into trouble.

I have had quite a few problems with them, some faulty goods and some dia delivery problems, but if you get the right supervisor or the manager they are normally pretty good at sorting it out - I still order from them and would not if their CS was not up to scratch. My Phone calls have normally been answered within 5 minutes which is pretty good compared to many online retailers.0
