Is the orignal Lease important?

Hi - we're trying to sell our Mother's flat. It's leasehold and I've just dug out the orignal Lease. Our solictors have asked for this oiriginal document.

All I want know is how important is this document? Does the Land Registry have a copy? Thy solictor is not local so I'm slightly worried about sending this by post...

  • Assuming title is registered then Land Registry should have a cop,y but buyer's solicitors still want the original handed over on completion if at all possible.

    Also, sometimes the Land Registry copy is not that clear so it helps to make a photocopy of the original to send to the buyer's solicitors.

    Actually the HIP company must have got a copy to include in the HIP, unless of course your solicitor is doing the HIP for you. By sending him the original you may save the £24 cost of obtaining an official copy from the Land Registry.

    As a retired conveyancing solicitor I believe the information given in the post to be useful assuming any properties concerned are in England/Wales but I accept no liability for it.

    Very good point but in my case the HIPs man didn't put one in until I pointed out he should of done by the legislation. Then he inserted one but the quality was very very poor as he had no idea how to create/merge PDFs and the whole HIPs was an absolute mess.
  • As it is a valuable document, send it Special Delivery and ask your solicitor to return it the same way.

    Thanks for the replies. Looking through my Mother's papers there are a number of copies of the Lease already. So I'll send our solicitors a copy and see what they say.

    Regarding the HIP, we haven't seen it. I guess as sellers we don't really need to see this. I assume it exists because we had an offer recently and I assume they saw it then.

    Nobody has said whether the original Lease is required to complete the sale? IE it sounds like a copy will do.

  • The original lease is extremely important, you WILL need to hand it over to complete the sale.

    HIP's aren't as important, most people probably wont bother to look at it, or even understand it. Most people will interested in the Energy performance bit though!!

    you have paid for the HIP why dont you want to read it? - if its a mess dont pay the full amount.....

    Pre paid and I guess you get what you pay for!!! It was a provider the EA said but only cost just over £200. In my case it was a case of spending the least possible on the HIP pack, to comply with the legislation, and whilst I have read you can get them undr £200 at least I didnt spend hundreds.

    I did ask for the provider to give me a refund but he hasn't done so.
