can a neighbour stop you doing a side return?

i know you have to consult them and follow the processes under the Party Wall Act; but ultimately can they actually stop you doing it?

    If your side return extension requires you to impinge on your neighbour's land for any reason (including foundation excavation etc), then their written agreement IS required.

    Your neighbour can stop you doing it.

    It is better to reach agreement with your neighbour, as you would probably be responsible for all legal costs involved if a dispute arose.


    If you can build up to the boundary without a foundation (eg by using an existing wall), you may not need their agreement.

    You need to consult a Building Control expert.

    i presume in most cases with a side return you do build a new wall, with new foundations, rather than using the existing side wall which i'm guessing is unlikely to be suitable!

    if the whole project is soley on your property then youre ok.
