Legal Aid - Pls move if in wrong place!

Hi everyone,
I need some advice on legal aid please. I dont know if I have posted this in the right place though.
We are being taken to court by someone ( and no we are not at fault...honest!) and they are getting legal aid. We are paying our own costs to defend the case. My question is that this person doesnt work and is 65 years old. I dont know if they get a pension or other benefits. But I do know that their house is valued at about £220k. I dont think they are on the breadline because of their lifestyle (doesnt dress like a tramp). They have been made offers to just settle the matter and are basically trying their luck and pushing for more as its not really costing them anything.
I seriously think their legal aid claim is fraudulent. Does anyone know if there is anyone we can request to look at her claim? What happens if we win, does she personally have to pay if she is on legal aid? (this is a civil case). Any advice appreciated.

Cheers. I have out this persons info into the calculator (well the suspected information like value of house etc) and looks like she should not be getting legal aid. Now what shall we do?!0

You cannot possibly know this persons income, if you do then you shouldnt.
House value shouldnt come into it. Do you really want an old age pensioner to pay his legal bill by selling his property.
The fact that they are getting legal aid is absolutely nothing to do with you and they will have to make statements about their income and capital. The legal aid people ae not stupid, if there is fraud, they will spot it.
Seems a bit like the green eyed monster to be honest, you feel a bit miffed that you have to pay and they dont. Dont get me wrong please, i understand that but you really have to look at your motives.
I hope you winmake the most of it, we are only here for the weekend.
and we will never, ever return.0 -
Hi Mckneff,
Thanks for your reply. I do understand what you are saying but I think you dont understand that this person is making things up and dragging us to court. The court have twice asked her for evidence and she has not been able to provide it! It seems mad that the solictors are not telling her to just stop. But I guess the legal aid is their income!0
