Company administration takeover

Hello,

I'm wondering if anyone on the forum could offer me some advice - my husband is part-way through a driver training course with LVG Ltd - 'RED Instructor Training' who went into administration on 16th February. They've since been bought up by Driving Results Limited. He paid for the course via a loan from Barclays Partner Finance which he paid off in full before the 12 month interest-free period ended.

There are a lot of rumours flying around about how people who signed training contracts under LVG Ltd will struggle to get any training at all as Driving Results Ltd aren't obliged to take the trainees on - if this is the case then is this legal?

Also my husband has not received any official notification from RED that they were ever in administration, and knows nothing about the new company. If we didn't keep up with the news he still wouldn't know - is it ok for them not to inform their creditors?

Any help anyone can give would be appreciated, thank you.

So training is continuing as normal then?
Otherwise he would've noticed something without having to 'keep up with the news', wouldn't he?

I don't know the answer, but if I was owed money like that I would be contacting them to find out what was happening.

You really need to contact them to find out what is happening.

I was never impressed by the RED business model. They seemed to offer far more than they could possibly deliver. £30000 a year after passing their course. You have to pay for a franchise with them plus pay weekly for the car. Your going some to earn the type of money they promised and competition is going to be fierce

He wouldn't have noticed straight away because it's a distance learning course. He only contacts them to book training sessions in etc, and during the last few weeks he had no need to contact them.

He has been in touch with them during last week to book further training and they just say 'someone will call you back'. He asked about the administration and why they hadn't notified anyone officially and the girl said 'I don't know that's nothing to do with me'. She may not be allowed to comment.

My husband wants to work a 40 hour week and understood that there would be some 'dead time' i.e. getting to and from pupils, but they guaranteed an unlimited amount of pupils at enrolment. I've heard mixed reports about them following through with this but I have it all in writing so if they fail to deliver we'll cross that bridge when we come to it!
