I still disagree.Yes but the company is paying people on that day it just takes 3-4 days for the money to hit their banks
The 28th is when they process the BACS to pay their employees, not when the employees get paid.
Rij's contract stated that he/she will be paid on the 28th (or closest if non-working day).
I'm sure if Rij goes to the cash machine on the 28th after being told in his/her contract that he/she will be paid on the 28th and a message comes back "No Funds available" Rij does not think "Yippee, I've been paid", you haven't, those funds could still be sitting in her employers account still gaining interest, they should be in Rij's?
I think we have another "technical point" here which I don't feel too strongly about to debate.

I have to say, as someone who is currently in this position, its very frustrating to hear people saying its your fault if you don't have enough money in your account (after the date you are supposed to get paid!!) - this is the same excuse my boss gave when i told him i would need to borrow money from my boyfriend (another debt) so i didn't go overdrawn and incur charges.
Surely this is the point of having a pay day? you get paid on a certain date, or by a certain date, otherwise whats the point? if an employer can just pay you whenever they feel like 'cause you should have saved for this!?!'
I have some debts that i am currently trying to clear - as are many other people on this forum i'm sure - and i do currently live pay day to pay day - and have no savings as its better off being spent paying off my debts.
Therefore, being paid on time is important. and no employer should be allowed to get away with it, at least not unless it was unavoidable - and was explained properly to the employee in advance of payday. but in my case, and the case of some of the others on this thread, there seems to be very little explanation as to why its happened, and no assurances it wont happen again.0 -
You should get paid when contracted.
Your employer should reimbure your costs if it is late.
But how much hastle and fighting do you want to go through every time it is late.
Better to make your life easy and give yourself a few days before the bills to go out especialy if you know your employer is unreliable and likely to fight costs.
Not having some buffer for cash flow just leaves you at risk, not just from getting paid late but other events that need cash.
If your employer pays late ask how they want to pay any charges(even if there are none). Expenses claim is one way and you could just put one in.

Not paying at the agreed time will often be a breach of contract. If you can prove you suffered a financial loss (for example, having to pay overdraft fees), you can claim this back as damages. Talk to your employer first. If it keeps happening, you could try to get a court injunction to stop them repeating this breach.0
