Late Pay (I think?)

Hi,
The date on which I get paid is becoming increasingly erratic, and it's making things a bit difficult with budgeting/planning.

It says in our contract that we get paid on the working day closest to the 28th of the month. I interpreted this as meaning we would receive the money either on the 28th, or the closest working day of that month.

That's certainly how it used to work, however in November I didn't get paid until the 30th (closest working day 27th), I didn't get paid until the 1st February (28th January was a working day), and I still haven't been paid this month (meaning it's going to be the 1st at the earliest).

Is there anything I can do about this? Am I misinterpreting the contract?

    It could be that they process the money on that day however it could be 3-4 days before the money hits your account......do you know if your company have changed bank accounts?

    I'm not sure, but they pay by BACS which is credited on the 3rd day. They're certainly not processing it on the same day every month.

    If this is the reason as well, surely it should say in the contract that it's by BACS? I mean, if it allows them to use a 3 day delayed method, then surely they could use a method that took a month and it would still be allowed?!

    At my last company, we were meant to be paid on the last working day of the month, but they used to process it on the 25th and we'd get it on the 27th. If there was a bank holiday, or the 27th landed on a weekend it'd be earlier.

    If say, they did process it today (closest working day), it wouldn't reach the accounts until the 2nd. That's going to bounce direct debits for a lot of people who expect to get paid on the 28th.

    Whatever happened to the unwritten rule/obligation of every Payroll department to ensure each employee is paid the correct amount AND ON TIME ?
    BACS do take 3 days to be cleared but this should be taken into account being processed a minimum of 3 days before payments are due into employees accounts by the agreed pay date.

    ON TIME could be that the payment is on the 28th but the money goes through via bacs, if that is per the contract that is on time

    Hmmmm! not so sure ? :think:
    If your contract states you will be paid on the 28th, that's when you should expect to see your money in your account.

    The contract just says 'salary of X to be paid in equal monthly instalments on the closest working day to the 28th of the month.'

    I wouldn't mind so much if it had always been this way, and was the same every month! It just makes it impossible to plan things when you have no idea when you're getting paid. It can make months as short as 3 weekends, or as long as 6.

    Last month's particularly annoyed me, as we'd been paid early before Christmas 24th (even though we were told it'd be the 30th) so it meant not only having the Christmas period, but being paid 4 days late!

    If the contract stated AROUND the 28th, then the Company would have a cop-out clause as 4 days later is around the 28th, but so is the 7th depending on your viewpoint.
    The closest TO it is the 27th, the 29th is the closest PAST it.
    An employee could have Standing Orders/Direct Debits geared to this date suffering rejections and bank charges if the funds aren't there on time?
    Maybe they're having teething troubles with a new Payroll system?

    I would say that you should have been paid today as the closest working day to the 28th of this month. The closest working day to the 28th is infact the first day of a new month. In theory you should get paid twice this month (March) now you haven't received last month's money (Feb) within that month. To be honest i would approach your employer and get clarification on this. They would be far better off paying 12 instalments on the 28th of each month (in your account), that way everyone knows where they stand.

    there are 2 issues here

    1. when you get paid.
    Well that is only a few days either side of the 28th, needs sorting but should not be that big a problem. Move any DD to a few days into the month.

    2. Your budget.
    a. no buffer funds, build up one month buffer(more for loss of income).
    b. you got paid early in Dec this should not be a problem you just don't start spending it till Jan.


    you seem to be spending your money when it comes in rather than budget.
    Have you done a SOA to cover a full years expences.
