RBS - Help please

Hi all,
This is my first post, so please be gentle.:)
I am 55 & married with a mortgage. We have been with RBS for nearly 20 years and over this time we have a Royalties Gold account and had various overdraughts and loans with RBS. In general we have been a good customer and yes over the years we have paid over the odds in charges (and yes we have missed the claim for Bank Charges!). We have a number of insurances with RBS for the account, overdraught and loans.
Anyway, to the point. Last September (first time ever) I was made redundant and found myself queuing at the job center. What a game! (that's another story!).
At this time I owed around £2,500 overdraught plus £12k loan. All insured. Completed a RBS Insurance claim form - listing the Account, Overdraught, loan and mortgage on the form.
Every two weeks when I sign on, I have completed a ABI1 form and send this to Bristol together with my Job Centre "Looking for Work" Record (ES4JP) (to prove I am looking for work) currently by Registered post.
They have not been paying! Eventually, after some months they paid 1 loan payment into my RBS account, because this was now over the overdraught, the bank swallowed it and the loan was not paid! I spoke with loads of departments - Bristol and Birmingham collections mainly, who eventually credited some money which the bank charged me for incorrectly. Anyway, as the bank bounced the RBS loan, I got a charge. Because the loan was not paid, I was charged! and on...
They have paid twice more since then.
Next, the overdraught cover insurance, was and has never been paid as far as I know. Every time I have spoken to RBS, they have said there was no cover. So I dug all my statements out and and took them up to my local bank manager to confirm this. (paid thousands over the years!) They still did not believe me and after massive arguments and with the help of the Banking Ombudsman, it was arranged to go to my local branch to meet the manager (whom I know!) to prove who I was and that it was me who had this account!! There was an open conference call with all parties involved. (is this ridiculous or what!)
As far as I know, no payment has been made yet! In fact speaking to Birmingham collections last Tuesday they said I was not insured for my overdraught! This is sending me mad!
Since September 2009, I have spent in excess of £130.00 calling RBS various offices in Birmingham, London, Bristol (I am with Virgin who charge for 0845). My wife, through the stress of all the calls and communication is currently seeing the doctor and I am worried that the latter turn of events may send her over the top. I have made official complaints to RBS and latterly to the Financial Ombudsman. Still waiting though I have received letters saying they (RBS) are investigating.
Yesterday ( Thursday 26 Feb) We received letters from RBS to say that they wanted full payment of the overdraught and loan by Saturday 27 Feb - close of business! £14k plus!
Today I have made another complaint to RBS and opened another complaint with the Financial Ombudsman about this.
How can this be. As far as I am concerned, I am insured for my account, my overdraught and my loan - How can RBS do this to us???
Maybe I should go to court to see them laughed out of the courtroom. Thinking about it, If I made a claim for all the Insurance I have paid over the years (Thousands) it possibly may pay this off!! But that would not pay for the hassle, stress and especially the ill health my wife now has!
I wish I lived near to Stephen Hester........
I would love to hear your comments and especially anyones advice regarding this.
Thanks all,
Regards,
Dave

Have a look on the main site for Payment Protection Insurance mis-selling reclaims.
PPI firms are cowboys, it is highly likely that you were mis-sold the policy in the first place. The fact they have not been paying is tantamount to this.
Send a registered letter to RBS to complain about both policies and request a refund of all insurance premiums paid. If its thousands and you win, that could be game over for some of the debt.

Arrrrhhhh!
Just had another call from Birmingham collections this morning asking for payment to bring the account into credit.
We had 45 minute conversation about me being out of work and I am insured for my account, overdraught, Loan and mortgage. He said that was another department and wanted payment!
He did not know that the final demand letters had been sent out!
He also said I was not covered for the overdraught - arrrhhhh. Start again! I explained I have been paying between £17.00 and £28.00 per month for as long as I can remember! Don't go there!
He then said that I needed to prove that I was looking for work and getting interviews!
I explained I had gone through all this at the very start as originally I was told that I must prove evidence of at least 3 interviews each month. I said I could not. They said that it would not be paid. I explained that the job I do, there was only about 200 in the country. How many vacancies would there be? I also said that this was not in the contract originally when I signed and them knowing the job I was in - it would be a case of miss selling! They sent me a copy of the contract - No it was not in there, except it stated that they may require information regarding seeking work! Which I do, by sending the JobSeekers seeking work form I have to fill in.
At the end he was apologetic and understood my stress and concern! He also said he would put a stay on my account and would also credit my account where I had been charged incorrectly.
I am going greyer by the hour.....
What am I to do with RBS????0 -
I would suggest you refuse to talk on the phone and get all communication in writing.
It may not sort your problems but it will save the recurring frustration of repeating yourself time after time and give you the rocord you will need if you need to go to the ombudsman.
Have you lodged your complaints in writing?"A nation's greatness is measured by how it treats its weakest members." ~ Mahatma Gandhi

Thanks for the reply missle.
Yes! I have opened an official complaint to RBS and also asked the Fin Ombudsman to open one against RBS directly (currently got one open for RBS Directline).
Cheers, Dave0 -
Hi All,
As I have said previously, the PPI's for my my Loan with RBS has been paid regularly (at long last) though the Royalties Gold account Overdraft has NOT been paid at all!
This has been causing a major issue, as the loan PPI is paid into my account, as the overdraft PPI is NOT being paid, they bounce the Loan payment and charge me. Then the loan charge me. Then again a payment goes in and it all starts again! What a round-a-bout!
I found out last week, after an other letter of complaint to them via the Financial Ombudsman, that they now say that the overdraft PPI is in my wife's name!! Which is ridiculous! I opened the account then changed it to a joint account, I am first named, I am (and always have) been the main "breadwinner"! All other PPI's are in my name. Also when I opened the account, my wife was NOT working at that time!
I believe this is a clear case of PPI miss-selling and have told them so! They say that someone is investigating.
Today, I receive a letter from Triton Credit Services (part of RBS) demanding £12,577.00 within 7 days. I am absolutely fuming!
I have rang them and explained the Financial Ombudsman is involved and the account should not be as it is, due to having PPI's to pay for all this! They have noted what I have said and asked for a payment. I replied I cannot as I receive £0.10p per week job seekers allowance (Yes! Another bum claiming a fortune off the state!) and my PPI's should be paying everything off!
I just wish they would take me to court. I am sure that they would be laughed out of court!
Regarding the financial Ombudsman, what do they do! My wife and I are at the end of our tether (my wife especially). This case (2 complaints) has been going on since the beginning of the year and they only moved when I copied in Stephen Hester (chairman RBS), my solicitor (fictitious!) and Moneysavingexpert.com.
Any advice to go on from here please .... I am getting desperate, especially as all PPI's run out after 12 months and I am into my 9th month!
Look forward to some good advice,
Regards all,

Quick update to say that I have sent an email to the Financial Ombudsman and waiting to hear back from them.
Any advice welcome! Anyone know of a good PPI solicitor?
