TDS basically refer me back to the LL on a recorded message, but I dont' want them to know i'm checking up... can they tell me over the phone if they have my deposit?0

Yes they can - they told me this morning
I bended the truth a bit and said I had written to the Landlord requesting info and he had ignored me and they told me they held no deposit for this postcode and even searched the address by street name to double check0 -

Try and send him something asap requesting confirmation of where the deposit is held within 14 days and suggesting that if he hasn't you will be happy to accept that the last months rent is in lieu of rent maybe ( and ask him to confirm that in writing ) If this date crosses over the threshold for your last months payment you can confirm the payment is stopped but you are holding it in X account and have the means to pay but will not until the whereabouts of your deposit is confirmed in writing
And take a video /photos of the house when you leave so LL can't make up damages ???
Seems to be a grey area . I don't see why we should have to pay the last months rent if they have fiddled the law but legally we are supposed to and then wait to get it back . Whether the LL would bother to take you to court for a months rent when you paid the same in deposit is another matter as I guess they have to pay to issue a claim ??0 -
my intentions are to tell them to use my additional rent paid as my last months rent seeing as they failed to place it in a protected scheme. if they make a fuss about anything in the house which is pretty clean, only I have filled in some little holes from hanging pictures, then I'll kindly remind them, the've broken the laws and I can legally challenge for 3 x times the "bond". I will take photo's of the house once all my stuff is out. with a recent paper in frame.
To be honest, they have been fair with me, apart from deciding 4 months into the 6 month AST they now want to sell after assuring me it would be a long term let (which I pointed out would be the only reason I'd accepted to move in as I wanted some stability for next few years), they are a company that build homes etc.. so it wasn't a case of one person needing to selll thier property as they have indicated it will be empty for them to "refresh" it for sale.
(I also know the person interested in buying, found out yesterday, and they are yet to agree price in this house and sell their current one!)0
