Not being paid all hours worked.

If you're not warned that you're not pulling your weight, then it's IMO automatically an unfair deduction, and you'd be entitled to go back to your manager and say "I worked X hours but I've only been paid for Y, please pay up".
However, I think you can guess what will happen if you do this, unless EVERYONE agrees to do this, and unless you have a timesheet where your hours are recorded and signed off by a manager then it will be your word against theirs.
You have legal remedies, but frankly it's likely to work out easier to find a better job. And I know that's not easy either.
Actually you could take this a different way, and suggest that signed off timesheets are introduced because you seem to be being paid for fewer hours than you have recorded in your diary.Signature removed for peace of mind0 -
Yeah the wage slip says 63 hours.
My hour's are inputted daily into the computer system (or every two or three days) from the sign out sheet by the three managers. So each one of them has probably shaved my hours by 2 hours each and not realised it was going to add up.New Years Resolution 2010 : Save £3000 for a House - £3000/£3000!:jNew Years Resolution 2011 : Save another £3000 for a House - £500/£3000Florida September 2011 for my 21st BOOKED! Is this the first time it has happened to you? I know you said it happened to others?
Oh sorry another question do you ever see your time sheet or do all that? Or the sign in/out sheet? did they have the correct times on them?0 -
No one told me they were going to deduct anything from my hours.
It happened last month, they deducted 7 hours, and probably happened every month before then, I just didn't write my hours down to check.
We have a sign in and out sheet that is kept with the rota and we each sign in and out for our shifts. They then take that sheet into the office and put those times into the computer, apparently scrimping a few hours here and there!New Years Resolution 2010 : Save £3000 for a House - £3000/£3000!:jNew Years Resolution 2011 : Save another £3000 for a House - £500/£3000Florida September 2011 for my 21st BOOKED! I don't think they'd get rid of me, I'm one of the few staff that turns up every shift, actually does what I'm asked and goes above and beyond my job description.
But obviously you're right, they're not going to listen to me really.
It annoys me because I get on well with all the managers there so I don't want to cause a lot of grief over 5 hours, but it's 5 hours pay I could do with this month!New Years Resolution 2010 : Save £3000 for a House - £3000/£3000!:jNew Years Resolution 2011 : Save another £3000 for a House - £500/£3000Florida September 2011 for my 21st BOOKED! Don't suppose it could have been a mistake?
Maybe not if they have done same to others...but could you just play dumb about that and politely ask one of the managers if he/she wouldn't mind checking your payslip for you as you think there might have been a mistake because it's only got 63 hours on it, say you have only just noticed it.
Gives them a chance to put it right or at least they will need to explain why you have only been paid for 63 hours.
Make sure you know how many hours you should be working from now on-if they are paying for 63 then only work 63.
Good luck, let us know how you get on.
If they can not explain it and/or sort it out then start looking around for another job as well.0 -
If you don't think they'll get rid or just stop giving you shifts, then it's worth raising it. BTW, do you get a break in your shifts? They might also turn round and say that your hours aren't taking account of that, but it ought really to be on the timesheets.
The point is that if someone's not pulling their weight, then the way to address it is to point it out, and ask them to get moving. It's not right to just deduct an hour from their pay a month later! Especially as if it's done the way they're doing it, you have no right of appeal, and actually no incentive to keep working hard if you think shifts are going to 'shaved' arbitrarily.Signature removed for peace of mind0 -
Chances of it having been a mistake are slim, but I will take your advice and play dumb about it!
We get a break on shifts 7 hours or more, but we mainly work 5/6 hour shifts, and since starting uni I havn't worked anything long enough to get a break.
I do agree the way they act is unfair. I get annoyed myself when I'm the only one on shift pulling any weight and shaving their wages isn't the right way to go about it, but hey, I'm just a waitress!
Thank you both for your advice, I spoke to my manager and arranged to talk to him on saturday so I'll let you know how I get on!New Years Resolution 2010 : Save £3000 for a House - £3000/£3000!:jNew Years Resolution 2011 : Save another £3000 for a House - £500/£3000Florida September 2011 for my 21st BOOKED! Well, watch out for them arguing that they gave you a break in a shorter shift ...
And note that any shift over 6 hours REQUIRES a break! Legally.Signature removed for peace of mind0
