Injury Claim

Ok say there was a very very small accident at 10mph which results in not going through insurance but getting the car repaired privatly. The small accident was registered with the police. Now say 1 member who was in the car that was hit wants to make an injury claim, I take it for it to go through there would of had to of been an insurance claim made sucessfully? Or can it just go with the incident number from the police?

    OK. Say you were a passenger in your friends vehicle which was stationary in traffic. There is a very very small accident because some inattentive driver runs into the back of you. You suffer a whiplash injury. You are in pain, discomfort and lose money through being off work. You want compensation. Your good friend tells you you can't start a claim through their insurers because they don't want their insurers to find out so go sue the other driver yourself. Some friend eh?

    Vehicle insurance is legally required for exactly these circumstances. It isn't there just to see how much NCB you can accumulate.

    Do the right thing, notify the insurance company and let them sort it out. Thats what they are there for.

    No you have it wrong. I'm the driver of the car that was hit at less than 10mph. I'm on a traders policy but all the car needs to repair it is the bumper painted as there is only 2 very minor scratchess both about an inch long. I could even live without even getting it repaired as you wouldn't even know it was there unless pointed out.
    reason I was asking is the other person in my car is claiming to me they cannot walk due to the accident, if you could even call it an accident. And they think they will get in excess of 5k plus compensation. Really I think they think this is a quick way of making some money.
    I'm getting the bumper painted by my other half as we have a garage, and billing the other driver. They have agreed to this.
    so as I think the other person is just wanting some money our of this situation I was just wondering if she would be sucessful in her claim seeing as getting my bumper sprayed isn't going through either insurance company? I also posted in the insurance section and got my answers there

    did she go to hospital/docs if not there will be no record of her injurys, and her claim would be hard to prove, 5k? where did she get this figure?
    she could either claim from your insurers or the person who hit you, but still she would of either gone to the docs or hospital, she claims she cannot walk is she recieving physio? if not again this wont look good for her, she can go to a solicitor and give her accounts of events and yes it may be picked up by one depending on her story, by law you would have to privide you insurance details if she persue you for the claim if requested by her solicitor, but i wouldnt worry if she hasnt gone to the doc or hospital at all then a solicitor wouldnt pick this claim up. it would be hard to prove.

    yuo say on a traders policy, did the bump occur whilst on a test drive or other form of business, if not were you insured to have a passenger in the car. i remember something about passengers and trade plates with passengers not being allowed in certain circumstances

    I need your advice and recommendation regarding personal injury solicitors. I want to make a claim and I don't know what choice to make. The personal injury solicitors I came across: Claims Direct, Claims 4 Free, McKeowns Solicitors and Fenton Solicitors. Any suggestions welcome. Thanks.

    I'm no expert, but I've no doubt your passenger will be able to make a claim against the insurance company of the car that was at fault, whether that's you or the car that hit you. It will not matter that no claim was made at the time.

    Were you on a test drive at the time?

    Could this be a scam?

    Saves on damaging two cars if ones a demo and if its an accompanied demo then there is a witness perfectly placed.

    I know most of the focus on scams is on deliberately caused crashes but I have seen an increase in recent insurance claims where the claimant is responsible for the crash. Often with minimal damage to cars but severe and long term injuries.
