Connection fitness-different colour bench

My bf ordered a weight bench through connection fitness. On the website it says it's a cream-grey colour but it's a gold-grey one. He doesn't like it and wants to return it, though connection fitness says he would need to pay £15 for collection. He thinks CF should pay for this as they sent us different colour-CF says it's his responsibility to pay for it. Where do we stand on this? Who needs to pay for returning the item if it's not as described?

    Is there anything in the product description or the terms and conditions that products may be a different colour than advertised? If there is then you can still return the product but they are within their rights to charge for return postage (or you could arrange the delivery yourself, but it probably wouldn't be much cheaper).

    If the product was explicitly advertised as being a specific colour and there's nothing to indicate it is different, then it's an issue under the Sales of Goods Act since the product is not as described, and it's up to them to either supply you with the correct item or give you a refund without any additional cost to you. If this is the case then just write them a strongly worded letter/email insisting they collect the item and replace it or refund it.

    This is what they wrote to us:

    'the website does state that the picture is for illustration purposes and the colour described is grey/cream and that is the colour of the bench that was ordered and sent'

    The bench is gold/grey, not grey/cream-this is what they wrote about it:
    ' gold is a cream colour and it is a matter of personal opinion'.

    We have 7 days of returning it-the courier company can only collect it between 1p.m and 5p.m weekdays,and not at the weekend, the next time we are at home during the day is next Wed. I don't really know what to do.

    Have to say when I read the OP,without seeing the response you got,my instant thought was that gold-grey could quite easily be what is called cream-grey.So honestly if he doesn't want it he should pay.

    And yes,some 'creams' look goldy

    Don't know about the colours, but as for returning the item under the DSR, then you only have to notify them in writing within 7 days starting the day after delivery, they then have to refund you within 30 days - there is no stipulation on them having to have received the item within 7 days.

    Ok. I think my OH is overreacting things, he should just get on with it but knowing him better find out all the options.

    True but all they are stipulating is that the op has to pay return postage which they are able to do.

    As for cold and cream, i would never consider them the same tbf.

    I suppose this comes down to if the picture had a clearly cream and grey colour, if so i would say its reasonable to assume that is the cream-grey you would receive. Not cream and gold.

    Is the gold actually shiny or not?

    Me thinks this may take a district judge to decide what colour it is.

    I've had a look on the site and spotted a cream/grey one that looks like it's goldish cream on my laptop.It isn't matt fabric either which means any creamy colour would look a little more than plain cream (quite often the case anyway) and different screens can show colours slightly differently and the pics are done in different lighting

    ps I'm assuming your boyfriend means it's a champagne type colour rather than bold in your face gold!
