    Why do you think this is untrue? Maybe yours was the first instance in their experience where a refresh was required......

    Who are you going to complain to, and what will the substance of the complaint be?

    I think it was untrue because home reports had been in use for 8 months at that point - and from research I have done since (ok should have done it beforehand, I now realise) it seems that a lot of lenders won't accept a home report more than a few months old. It's not a one man band type estate agent I'm using, it's one of the big national chains. I think they told me what I wanted to hear in order to get my business -and it worked.

    I will complain to the manager of the branch on the basis of inaccurate information / advice, however it's mainly me letting off steam - I very much doubt I would get any redress.

    The moral here is - if you're paying for a home report, don't forget you may well have to pay to get it updated later, unless your house sells fairly quickly. You live, you learn...

    Why aren't you and your solicitor getting the buyer to pay for the refresh?

    You've got an HR that's valid according to the law, they're the ones who aren't accepting it as valid, you should be digging your heels in and getting them to pay for it.

    i am concerned as my EA Countrywide provided my HR but also are providing my buyer with a mortgage i feel there is a conflict of interests as they now are working for us both.

    This is not necessarily a bad thing. And, no, the EA is not working for the buyer. They are working for you and for themselves. Hence, they want the biggest possible offer, as their cut comes from the offer. The buyer has made an offer and their mortgage section is taking it forward.

    In some ways that can be good for the seller, as it means the EA is aware right off if there's a problem, like the buyer doesn't have the funds, is unlikely to get a mortgage etc.

    It all depends who's the more desperate doesn't it - him to buy or me to sell. Or who has the tighter timescale. You can probably make a guess on this based on the fact that I am just paying it without arguing!

    It does seem that the market is picking up though - around here at least. When I phoned various estate agents a week or 2 ago to view properties I'd seen on rightmove, around half of them were either under offer or sold. I was getting very frustrated at how few of them update their listings to say so but it may be looking up a bit for sellers.

    Yup, whoever blinks first loses.

    Why not look for properties on the agent's own websites rather than Rightmove? They might be more up to date and have more properties. Rightmove only has about 30% of the available properties where I am (Lothians) - which area of the country are you in?
