Bank Charges

Hi,

My parents are looking to claim back a load of charges that were incurred during a period when they were running a business. The charges were the sole reason why they went out of business.

They actually went into an IVA which they have completed. They have sent out the first letter 3 weeks ago without any response. So they are looking at the 2nd stage, but are a bit worried that because they have been IVA and in a business, that they won't be able to claim back any charges, and don't want to waste £50 claiming.

What should they do?

    So do you think they have a chance? £50 is bit of a risk, especially if you don't really have it.

    Why £50? As I understand it you pay £10 per bank (not even a/c) I claimed my CC and C/A with the same bank with one £10 cheque

    Have I missed something? Sorry if so!

    Anyway check out The Consumer Action group for more detail but I would say Yes. As long as its within 6 years, any charges on any account can be claimed back.

    i'll nip over there, but £50 is what my folks say. Also if you go through the claim online thing, which is the 2nd part, it costs between £30 and £150. According to Martin Lewis anyway.

    If they're claiming wtc or a similar income boosting benefit they can fill out a form to be exempt from paying the fees.
    This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!

    The £10 is for the list of charges uder DPA, the £50 is for the small claims action.

    Have they sent a "letter before action" yet? That's the second stage. Also I gather that the bank has 40 days to respond, or am I wrong?

    The second stage is the small claims action, isn't it?

    Well its step 4 on the article in this site.

    Step1 - the letter
    Step2 - the spreadsheet (which both get sent first)
    Step3 - wait for a response (there has been no response)
    Step4 - Small Claims Action

    no theres a prelim asking
    then a second letter asking
    then the court fees.

    When suing anyone you will risk the fees - but I dont know anyone on CAG thats not got thier money back yet ;)
