Not been paid for two months

Surely if you are employed as a supply teacher, they already have a CRB to use?0

Three points here:
a) No pay
b) No CRB
c) No employee file
First things first... A CRB (Enhanced Disclosure) check is now a legal requirement in order to work in a school.
How did you by-pass the council? (you went straight to the school?)
Basically i applied for a full time post in july last year, went to interview but just missed out so when the mat leave came up they offered it straight to me, i had not been in contact with the council, just the assistant head at the school who offered me the position.
i had a few meetings with the said asst. head and also the woman i would be covering for before starting and was given a start date of mon 4th jan so xmas came and went and i started at the school just like a normal new member of staff, i have a mentor and nqt activities as normal.
i and also the members of staff i have spoken to just couldnt belive that i was working in the school yet the school nor the council had any proof of my qualifications, criminal record (or lack of) or medical details.
I spoke with my mentor today and she told me to go diirect to the head however he was out today so instead i spoke with the asst. head and he was apalled! he has said that even if he has to pay me using petty cash he will sort it out this week, im meeting him tomorrow morning to hopefully get this sorted so i will let everyone know the outcome.
i just cannot believe the incompetance of the council - having the nerve to tell me they cannot pay me until the crb comes back, that same crb application that had been sat on a desk somewhere in the council offices for at least a week!
ok rant over thanks for all the advice everyone i will post tomorrow about what happens
oh and my union rep now knows about the issue too.0 -

No money
Work=pay. It's as simple as that!
It's illegal not to pay.
I'm sure it's even worse to have you working without being on the system, what about risk assessments, induction, training, H&S etc etc?????
There are people to trust them to look after their kids, how wrong they are!0 -

These people deserve their positions. I seem to remember the deputy head at my old school was brilliant - so full of energy... anyway lol I digress. I think there are a dangerous few days coming up. This will spiral up through management, who at the top level will go completely off their heads that a school is employing someone without a CRB. Lower down in management, they already know this could crop up - hence no one has authorised the salary to be paid - hoping it will go away when kelly walks out for not being paid.
This same lower down level of Management will try to deal with the situation by more proactively trying to get kelly to leave and spare them the embarrassment of an on going 'serious' anomaly. When that does not work, they may try other tactics, such as keeping kelly employed but getting her to do filing at a non school location or some such.
Kelly, be strong. Talk with your union rep. Don't discuss with management without a rep present and don't agree to anything without talking to your rep first. It will all blow over once they realise that the quickest way is in fact to deal with your CRB - which is going to be a lot easier than kicking you out. This seems a bit extreme, they have made a mistake but it does not necessarily mean they will want to get rid of her....
Taking a confrontational approach when you don't really know what management are planning to do can backfire.

Let us use a timeline...
July 2009 - You applied 'direct through the local council' for a position as a teacher but 'just missed out'. You are, nonetheless, kept 'on file' by the council.
Between then and now - A vacant position came up due to maternity leave.
January 2010 - You start working for that school after they call you and inform you of that vacant position.
Since you have not been in contact with the council, since your interview in July last year, should not have your school contact the council and inform them of you being now on the staff roll?***L'union fait la force***0 -
