Field and Trek order - anything I can do?

Options
Hi all,

I'm new here and have tried reading through bits covering the topic I'm asking about but most of the material refers to much bigger ticket items. I'm guessing this means there is no hope for this as it certainly is too small a purchase to follow through legally, but I thought I'd seek advice just in case.

Basically I ordered a "Lifeventure Ex3 silk sleeping bag liner" see [can't post link as new user but you will get there if you paste this after the main web address for field and trek] /lifeventure-ex3-silk-sleepers-781083

from Field and Trek at a seemingly very good price. The item was marked sale so I didn't seem all that suspicious as I know that the line has been replaced with a newer version of the same thing.

I however did take screenshots of the price online and have received e-mail confirmation with the correct product code/description.

The order was dispatched but I was sent a cotton sleeping bag liner. I eventually found a number to ring (0845 one for Sports Direct) and after much time spent on hold I explained that I had been sent a cotton one not the silk one I ordered, the advisor apologised and arranged for a replacement to be sent and gave me a freepost address to send the cotton one to.

One day later, I received the new liner - again a cotton one. I opened it when the DHL delivery guy was still at the door and so just refused delivery so that it will go back to the company without me having to make another trip to the Post Office. I ring again, spend a long time on hold because the extension number I was previously given was incorrect. The advisor says she will ring the warehouse and check with them and get the right product sent out.

Having not heard anything I ring back, speak to another advisor who agrees to chase it up and as of yet I am still waiting for a call back.

The Terms and Conditions on the website read:
How the contract for the goods is formed between you and us

After placing your order you will receive an automated acknowledgement. Please note that this does not mean that your order has been accepted. All orders are subject to acceptance by us, and we will confirm acceptance to you by confirming that your order has been despatched (by us for UK orders or by Etail Services Limited for overseas orders For UK orders (i.e. orders to be delivered to a UK address), once we accept your order, a contract to purchase and deliver goods takes effect between you and FieldAndTrek.com Retail Limited. For overseas orders, once we accept your order, a contract to purchase the goods from FieldAndTrek.com Retail Limited, and (if you have selected the overseas delivery option with Etail Services Limited) a contract to deliver the goods to you takes effect between you and Etail Services Limited (please refer to Overseas Delivery below).
The contract to sell goods to you only relates to those goods listed in the confirmation email. Our Goods

A description of the main characteristics of goods can be found on the product pages of the Website.
Prices for goods on the Website appear on the product pages and include all UK taxes.
Prices and offers may vary and may only be available for limited periods. All prices and offers are subject to availability and may be withdrawn or amended at our discretion. The prices on the Website may differ to prices in our retail stores, catalogues or elsewhere.
The Website contains a large number of goods and it is possible that, despite our best efforts, some of the goods listed on the Website may be incorrectly priced. If we discover an error in the price of the goods you have ordered we will inform you as soon as possible. We will give you the option of reconfirming your order at the correct price or cancelling it.
We are under no obligation to sell incorrectly priced goods to you at the incorrect price if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error.
Ownership of the goods will pass to you when we receive full payment. The goods will be at your risk from the time of delivery.

I take from this that I have a contract with them as they have despatched my order but that they do not have to supply anything they discover to be incorrectly priced.

However the thing is, the fact that I keep receiving the cotton one maybe just means that the item description is wrong not the price. I guess they probably still have the grounds to withdraw it under availability issues.

Any advice as to exactly what rights I have or what the best course of aciton is. I'm fed up of wasting time calling 0845 numbers to sit on hold whilst they lap up the profits.

The e-mail line said it could take over 5 working days to respond and I go away on Saturday.

Any help would be appreciated.

Dan

question, if you thought that everything was tickety boo and the price was a genuine sale price, why did you take screen shots?

Seems a bit of an odd thing to do tbh
  • I tend to take screenshots of stuff these days (or pdf printout) because of bad experiences in the past. I've had companies like (certain airlines) try and change T&Cs on me and rule on a case according to the new ones not the ones I agreed to when buying the tickets. Call it paranoia but it does from time to time payoff.

You could always look at Saynoto0870 for a cheaper number.
  • Thanks, but already tried saynoto0870, unfortunately only number is for the Universal Cycles bit owned by Sports Direct, no numbers for the main customer services or Field and Trek.
