jeggburt - hope you make the right choice next time, happy to give you more info, as I am always seeing estate agent agreements, some are shocking, hence my 'national v local' posting, and the things to check with the Agent.

I have been reading number of your posts and clearly you have a lot to say for yourself. Why don't you put a signature at the bottom of the posts and tell us on what basis you feel able to give out your advice.

Or let us know in a post?

We cancelled our agreement with our first agent first of all by phoning them up and then putting it in writing. We had our second agent ready to go the day after the notice period ended. We didn't ask for a list of people they'd provided info for (perhaps we should) and we ended up selling to someone introduced by our new agent within three weeks. I guess the reason you're moving is because you're not happy or because they're not doing a very good job so I doubt you'll have any problems with commission (but that's just my view). Best of luck.

    Something else?

Now lets all guess he works at the EAs printers who supply the agreements?

    Next guess?

But there could be a problem.

Old EA may claim the new buyer through, the new EA, was initially found by them? So best to get a list of who the old EA feels could be entitled to a commission claim from them. Then try and get the new agent to exclude anyone on that list. Better still give a written guarantee they will offer to share the commission with the first EA if any claim were to arise.

Nope not a problem. I think this is mountain out of a mole hill stuff. I know it happens but like I said in my OP above, people usually move EAs because they're not 'introducing' people to the seller, in which case there won't be a problem. It's worth doing to cover your back, but if there haven't been any viewings for a few weeks, then any new ones will come from new EA and that's that.

Possibly the alter ego of the said person whose posts seem to have died down?
