HELP - TV BROKEN - 11 mnths after purchase

I bought my son a TV/DVD combi (Darth Vader) last year 24th Feb from Toys R Us.

It broke last week - The dvd wont play or come out!!!

I have spoken to Toys R us and I have a bank statement for Proof of purchase!!! They said that it is nothing to do with them and I have to speak to the manufacturer.

is this correct? I thought that as it hasn't lasted 1 year I would be able to swap it for another TV/credit note for that store!!

The same thing happened last year. We originally had a lightning mcqueen tv which broke just under a year after purchase and they refunded us. hence the reason he then got the Darth Vader one.

What do I do? I only have one day to log that it has broken!!! Eeek:eek:

  • Toys R Us are fobbing you off, your contract is with them not the maker,

    I have taken things back to currys before with a bank statment as proof of purchase.

    Just go back and ask again, then point out that your warranty is with them for the first 12 months and its up to them to take it up with the maker of the TV.

  • Just read the terma dn conditions of Toys R us and they said that if a fault happens within 12 months of purchase I have to first speak to the manufacturer and they will give me a diagnosis and either repair it or send me to toys r us for a new one!!!

    Just spoke to manufacturer at IMC toys and she said I was cutting it fine!!! Cheek, I can't help it but it still broke before the 12 months. She eill be phoning me back!!! going to follow it up with and email I think so that it is in writing!!

    it is irrelivant what Toys r Us tell you, under the Sale of Goods act you are quite legally able to take it back to the retailer and ask for a replacement/refund/repair as long as you can prove there was an inherent fault with the product (ie independant test).

    Obviously if the manufacturers say they will sort it out then good however if they say they won't you have other avenues to go down with Toys r Us (not the manufacturer)

    The warranty on the unit is held with the Manufacturer, so any warranty terms will come down to what the t's and c's say.

    However, you do have a right to a refund/repair/replacement under the Sales of Goods Act through the retailer, but as it has been more than 6 months since purchase, the onus is on you to prove it was inherently faulty (usually done by providin an independent engineers report).

    Under these circumstances, i would think it wise to go to the manufacturer and claim under the warranty due to the tight timescales!
