  • natweststaffmember, is the lending code linked in your sig. legally binding? Or simply 'suggested' practice?

    Does Nat West abide by it?

    It's regulatory ie it is something the FOS would look at with regards to a hardship claim.
    With regards to the second question, read the one line above that link cos I don't work for them anymore.

    With regards to the second question, I am trying to clarify things but I believe that if you have no priority debts then financial hardship will be difficult to prove since that is the only way that banks might refund charges to accounts.

    I don't work for the bank, vaporate. I am not paid by them, I am not in a position to know their viewpoint, and I was sacked in February 2009.

    You need proof on the open forum cos I can provide examples of it, should you require it?

    im still trying to get my head around the historic charges, i must read in full the info on this forum maybe ive misunderstood, not sure how to do my next letters

    re halifax had written to them over 2 years ago, ive had the rejection letter that due to the ruling last year end, they are not paying me back

    barclays and rbs i was on the verge of doing my first letters and now im sort of stuck

    on all 3 i suppose i need to amend my complaints accordingly then?

    But this is where i thought the hardship could have helped since im not in a job anymore and all charges would clear the overdrafts instantly which i could explain im guessing as a charge being snowballed with more charges etc?

    fortunately, we had mortgage arrears and did clear them over a year ago, but that was when we had arrears due to me being off ill and we got behind i mean that is where i can use the human explanation of where we are at now? and what caused us not to clear the overdrafts as we were getting the charges ontop of charges

    thats where im at in my head and thats why i was unsure of how to properely proceed

    sorry for any confussion would appreciate any links for me to thoroughly read up and then i can action appropiately

    Administrative costs could be for administering current accounts including breaches and delinquent costs.

    But that's not the same as part payment for others banking.

    Why is important what the payment is for? Why does the use of the charge become important to reclaiming the charge back because that would surely be cost/level?

    Honesty, integrity, you know the things old people think banks are or have, when in fact the reverse is true.

    I just think if I want to levy a fee it should be for what I say its for not for otehr stuff. Case in Point IKEA charges for card payments because there is a cost, they charge a whopping 50p. Other companies have a similar charge and charge as much as £5.

    I think the only solution is the sort of law they have in other countries to ensure an admin fee is just that. We're never going to agree on this because I believe there is clear evidence that the banks were dis-honest, ie what they aregued in the supreme court was NOT what they had been saying to customers earlier.

    And what does the OFT stance and government lack of action do? It says sure keep pushing the envelope, if you go too far you won't even get a very tame slap on the wrist.

    Well I received my response from Nat West yesterday. It was short and sweet. We are not able to overturn our original decision becasue we do not beleive you to be in financail hardship as you have duplicated your outgoings and they beleive I have sufficient funds to make my financial comittments. I have checked the financial statement I sent them and I can not see what they are referring to as there is nothing duplicated.

    Is it worth going to the FOS ??
