Query re what i can reclaim

Hi

Have been on Nationwide Forum but seems to have died! I have sent a letter to Nationwide asking for detail of charges - they have sent me back a 4 page list of charge transactions which consists of various things:
  1. Interest charge
  2. Unauthorized overdraft fee
  3. Unpaid direct debit fee
  4. unpaid cheque fee
  5. unpaid bill payment fee
Can i just clarify with someone which of these I can reclaim? Also the address the letter came from is Refund of Charges Team in Moulton Park Northampton - I presume I send any further letters to them?

I currently have a reducing overdraft - now £3700 (reducing £100 each month) and their list of charges totals £2617 - would like to reclaim all possible plus interest as I am in hardship - mortgage difficulties and continually having my overdraft cancelled as I go over the limit - now cancelled direct debits and making manual payments to avoid charges as I cant keep on top - when a dd bounces they often represented and as i had no way of telling when they would do this - it often bounced as well as not enough in account - nightmare.

Thanks for any help!

At the moment, none of them. There is some work going on with new ideas on how you may attempt it but for the moment there is no news on that front.
would like to reclaim all possible plus interest as I am in hardship

When you say hardship, do you mean you meet the criteria for financial hardship or is that just your opinion of your situation? If you do meet the criteria, you can still put claims in under hardship.

Have you considered cancelling the direct debits if you are unable to control your finances to that level?

  • Hi

As i have said I have now cancelled my direct debits.

With regard to hardship - yes I believe I am in hardship ie. mortgage arrears - threatened with court re council tax (or rates here in NI) and behind on payments with everything.

it is my understanding that claims under hardship can still be considered which is why I am asking which of the list I should be submitting - I realise that they will then send financial forms to fill in - have already done some of these for a credit card company and been recognised as being in hardship by them.

Also have defaults on my credit score - and yes considering unenforceability for some of my debts.

    thanks in advance

Have a read of the lending code, page 20 in particular, to see if you might qualify for financial hardship in the eyes of financial institutions.

If you think you do, write to your bank and explain why you think you do. There's a starter of a sample letter in the MSE bank charges reclaiming guide for you to complete if it helps.

You can, as the title of the guide implies, ask the bank to consider the refunding of bank charges. i.e. if the bank agrees, it will put you in the position you would be in if the charges were never applied.
You cannot claim interest charges on loans/overdrafts you have agreed.
