Help with Refund

Hi guys im after some help

I orderd some goods online in january, with a delivery time of 5 days, i waited 7 days before i rang and was told them item was sent out on the 6th day after i had orderd and please wait 5 working days for delivery..

I was little annoyed at that but as i was in no rush so thought well at least i know its on its way.

a further 5 days i still have no parcel so i ring them again and they tell me 3 delivery attempts have been made and 3 cards where left and the item has now being returnd to us.

I told the lady i was 100% sure no cards had been left there is no way i would miss 3 cards can you confirm the adresse theese cards have apparently been left at?

Turns out they have deliverd to the "billing adresse" which is my sisters place and not the specified delivery adresse " my place"

I told the lady on the phone thats my sisters adresse as she was the card holder but we specified a diffrent delivery adresse.

She told me there was no other specified adresse on their system! so i dug out the confirmation email they sent me which does infact show the billing adresse which is my sisters and also the "delivery adresse" which is my place which is correct.

I forward'd the email while on the phone and she read it put me on hold for 10 mins then said, im going to have to look into it to see weather its our fault or the couriors fault, its clearly your fault as you have given them them billing adressse and not the delivery adresse, to which she replied theres nothing i can do but fwd this on to our delivery department and we will get back in touch with you.

Sorry buy its clearly not my fault its been shipped to the billing adresse why should i have to wait for them to decided if its their fault or the couriers before i get a refund?

its been 48 hours now and i have heard nothing back whats taking so long?

Im ready to ring back again now but any advice before i ring back? i need to know my rights.

Does it say that the first delivery must go to the address registered for the card holder?
