Barclaycard error in interest rate offer

Looking for a bit of advice

Was on the long term 0% interest rate credit card offer with Barclaycard for 14 months from October 2008, ie due to expire Jan 2009.

However on my last 2 Barclaycard statements Jan 2010 and Dec 2009 in error it started to say Interest On Your
Balance Transfer
BALANCE 3729.36
INTEREST 0.000%
TO Dec 2010

When before it was always saying to Dec 2009. In fact I had not noticed the error and as it was saying to Dec 2010 I just kept the balance there, whereas if I had known it was to end Jan 2010 I would of transferred the balance to another Credit card with a 0% rate.

Anyway, of course my statement for February has now charged me interest of £43.42 on the balance Interest On Your
Standard Balance
INTEREST 1.167%

So this is clearly Barclaycards error. I spoke to them today and they have asked me to write a letter to their Head Office with a copy of the statement showing the expiry date of the offer TO Dec 2010 as above.

This I will do but would welcome any advice on how to play this.

I would like to write to them along the lines that as the statements clearly showed 0% interest rate until Dec 2010 then a contract exists between us on these terms, which both parties have accepted and I expect them to honour and to cancel the interest charged.

Am I being correct legally in what I am saying? Any advice on legal wording of letter would be welcomed.

At the very least as this is their error, I expect them to cancel the interest charged and give me 1 month interest free to transfer the balance/pay off the balance.

    You mean 2010?....not only Barclaycard making typing errors...

    you contract with them is that they would give you 0% offer for 14 months so until 01/10....I don't think that you stand any chance

    No contract exists - you knew or should have known that it was an error therefore there was no basis for a contract.

    You might get away with a refund to date.

  • It's not a contract, because no such formal agreement was arranged between you, and a mistake on a letter is not enough to uphold a suggestion of such.

    However, it is their mistake, and if you send a photocopy (don't send the original - it will go 'missing') then they are obliged due to their mistake to refund the interest. They could try to worm their way out of it, but now that you have been notified that it is due to gain interest, then it is up to you to do something about it. From the point where you were notified the balance acrused interest, then they are free to charge.

    If they refuse to refund to that date's charges, then go to the Ombudsman.

    Other than that, get the balance shifted now, if you can.
