unwanted gift, lost receipt

I'm sure this get's asked loads, but I couldn't see anything via a search, so I apologise If i am being blind.

My mum purchased me an xbox360 for my birthday, bless her socks, as I asked for money so I could put it towards getting a Playstation3.

She must have got confused and saw a good deal on the Xbox so just brought it, however she did tell me when she gave it me she has already lost the receipt.

It's unopened. Should I be able to return it with a credit card statement?

Also should the retailer be able to track the item by the barcode or serial number on the box in their system to know it was purchased from them?

Odds are I will use the money back and buy a PS3 anyway, which costs more, so it's not as if they will be losing out on a sale.

She hasn't told me where she got it from yet as I don't want to cause too much of a fuss just yet without knowing if I'll have a good chance of getting it exchanged. This is of course assuming she didn't get it off the back of a lorry! :A

Only your mum can return it and get a refund/replacement however a shop does not HAVE to give you a refund if its just an wanted present. However if you go with your mum and explain to the shop that you want to buy a PS3 instead they will probably oblige.

A credit card statement is good enough for proof of purchase, however as I said if its in your mums name she will have to go and exchange it with you

If its from Argos, you'll have a fight on your hands.
There is a clause on their receipts about returning items like this.
but you can but try

Your mother has no legal right to a refund or exchange at all. Without a receipt I would assume that even the most lenient of shops would turn your request away.

We bought some football boots for grandson and lost the receipt.

They didn't fit too well and Sportsworld accepted return from transaction showing on our bank statement. The assistant seemed to check the date on her computer screen.

They gave a gift card to value as a refund.

It depends on the store. If you're exchanging it for a PS3 and paying the difference there and then, they might agree. No ask, not get.

Otherwise, hopefully your mum paid by card, so can use the bank statement as proof of purchase.

There's no right for you to get it exchanged, but if you're buying something more expensive, then the shop might agree.

Thanks for your help folks. I'll ask her where she got it from tomorrow and go from there. Hopefully it's somewhere that will be helpful, but I know how much of a pain in the backside it is especially with video game type stuff even when you do have a receipt.

Trust a Mother to try and go one better, get the wrong thing and lose the receipt! Bless her.

That depends. If she bought it from a shop that does refund/exchange on this type of item as per their terms and conditions (agreed at the time of contract), then she does have a right. Not under consumer law, but under contract law.
