Where do I stand re choice cat returning item sayifn it as been worn.

I ordered a few items from choice cat, And I sent them back as they never fitted. Refund was credited to my account no prob . I then get a call from the returns depatment to say that they have had a report on the trousers I had returned saying they had been worn as there is a stain in the gusset part which can only be described as blood she says. I explained I returned them the way I recieced them i never noticed any marks there and again i never went checking in the gueest part never do.
She said that she has to return them to me and i have to pay £3.95 for them sending them back to me. Allthough I sent them back not worn i only tried them on and they were miles to long so i returned them. If I had worn them then there would of been marks ont he bottom of the trousers due to be to long. I also returned them witht he tags on I would not wear them with tags still on.
So now I am stuck with a charge of £3.95 on my account and trousers that are no use to me.
Anyone know where I stand?

You get a independent 3rd party to confirm there is no damage to the item. then you may have a case.0
