Selling and Buiding Regs Indemnity Insurance

I am in the process of selling my house and have recieved a form to fill in from my sols on behalf the buyers sols. There are a couple of points that have me very worried, hoping someone on here may know the whys and wherefores and be able to put my mind at rest....

1. Copy of compliance cert for installation of CH required. (I haven't got this). In its absence, building regs indemnity insurance required (any idea of how much this is gonna cost?)

2. Have any works been carried out since original construction and if so please provide the appropriate Building regs approval and/or appropriate cert of compliance from any contractor ( CH installed (see above) also gas fire installed at the same time. No certs/bldg regs. Other works done - some electrics/building walls etc too. No certs for anything)

Had all my work carried out by a 'friend of a friend' at the time - yes I was naive :o. He did all my renovations - including installing the Ch and gas fire. He told me not to bother with any of the official stuff - this was 4 1/2 years ago and have no clue where he is now.....I did have the fire checked by a Corgi reg'd fitter afterwards - but can't remember his name (recommended by builder chap) and never recieved any certification.

So - now trying to sell my house - how much of a problem is this going to cause? Shall i come clean and confess to using a cowboy.....or merely admit to lost docs?? Will indemnity insurance cover the installation or does this sound like a long drawn out and expensive process......I'm really really worried at the minute....house on market for 2 1/2 years and we have now offerered on another house and waiting for Surveyor.

Any advice/ideas???

    Will be ringing sols first thing tomorrow - am so scared this is gonna put a massive spanner in the works.....

    My ex- vendor didn't have the central heating certificate and could have taken out the indemnity insurance which would have cost about £50. He didn't and kept saying he'd get the cert etc and then pulled out of the sale! My advice would be get the insurance on that one.As for the second part I'm sure someone on here will be able to help you.
  • Hi, We are in exactly the same position as we didn't get a completion cert for a boiler put in after April 05. We knew that it may cause a problem so had a gas safe certificate done at the same time as having a service to the boiler - it cost the price of a service but it was money well spent as it's alleviated my worries. Even if this is rejected by the solicitor at least my conscience is clear that the boiler won't blow up when the new owners move in!
  • Solicitors are paid to ask these questions, but most purchasers don't know or care about the answers.

    "The vendor was not given a certificate by the heating installer. The purchaser must satisfy himself by his own enquiries or inspection before purchase as to the condition or otherwise of the heating. Any insurances to cover the property after sale are the responsibility of the purchaser."

    "The vendor has not been in possession of the property since its original construction. The vendor is not in possession of any certificates. The purchaser must satisfy himself by his own enquiries or inspection before purchase as to the condition or otherwise of the property."

    If you can get a "Landlord's" safety inspection on the gas appliances that should provide some reassurance to any prospective purchaser. And if they want to get insurance against Building Regs contraventions (it's usually 'only' a few hundred £s) then let them pay for the policy, as they'll be the ones claiming under it.

  • Thank you all so much for your replies - I do feel better now about ringing sols in the morning. I'll certainly think about getting the boiler serviced/trying to get a certificate for my own peace of mind....but will leave any indemnity ins. up to the purchaser after hearing this.

    I'll let you know hoe we get on - but thanks again for your replies - and for the better night's sleep I'll hopefully get tonight!!
