iPod Nano Bought New Is Faulty after 2 weeks

I purchased a new Nano at the Apple retail store [Regents St] about 2-3 weeks ago. Due to a faulty home pc, I was not able to use the iPod until yesterday when I discovered a fault [cannot push the headphone jack far enough into the Nano for it to work].

I know that I can go to the so called 'Genius Bar' at the Apple store but last time I was there about 3 years ago 2 things happened

1. they replaced the unit but only provided a 3 months warranty for the replacement [the original unit was only 6 months old and carried a 12 months warranty].

2. My understanding is that the replacements provided by the 'Genius bar' are not new but actually refurbished units.

So questions please:

Given that this unit was faulty at the point of sale precisely what are my consumer rights.

In the first place should the remainder of the warranty period not be applicable/transferable to the replacement unit ie 49-50 weeks.
&
Secondly, am I not legally entitled to a 'brand new' unit as opposed to a 'refurbished' one.

Obviously, I need to go back to the retailer where I bought the iPod [Apple retail store] but would clearly like to know where I stand prior to arriving at the store rather than being railroaded when at the store due to not having the relevant information.

Any info much appreciated.

    As it can be argued that you are still within a reasonable time to fully reject the item under the Sale of Goods Act then I'd imagine you should be entitled to a full refund or new replacement. Take it back to the store.
  • Apple will most likely exchange it for a new one, just remember to take with your proof of purchase as you can prove that you brought it from Apple as opposed to another retailer

  • Thanks for your replies. I will see what happens and trust that Apple will not attempt to fob me off in the same manner as they did last time.

    At least this time I shall enter the store more prepared than last time.

    Just a comment on your point one.

    The warranty will be for the remainder of the 1 year warranty or 90 days which ever is longer. Do for example if it broke on day 364 you would have an additional 90 days. Wheras as if it broke on day 200 you would have the full original warranty.

    I have found Apple one of the easiest and fairest companies to deal with re warranty claims.
  • Take it back and get a refund. Then buy something with substance over style and hype like an iRiver or Cowon!:D
