Inter-Credit say the DVLA are preparing a claim against me?! CONFUSED!!

    I havent a scanner...

    it basically said the new owner has obviously informed u they r the owner cos theyve taxed it (in proper english!) and that its an admin error that id appreciate them sorting out as I dont want threats from intercredit due to their inaccuracies. I gave details of the new owner.

    the reply is similar to that u scanned... not good enough.. cough up basically...

    I expect you have a mobile phone with camera so that can be used on macro setting. (Just a personal thing I find it hard to read text speak, DD calls me a luddite, but who does she ask when computer goes wrong:-))

    The DVLA wants your money so do not expect an unbiased opinion from the other side.

    No, you said 'they' are now threatening Court, you can ask them to 'bring it on' (but not in those words!).

    So you need to write a formal reply.

    If the letter is from Inter-Credit then tell them that you deny this alleged debt and formally request them to stop contacting you and to pass the file back to the DVLA along with copies of your replies. State that you will only answer in Court to this matter, and their connection with it has ended now.

    If the letter in in fact from the DVLA, simply quote their refs and re-state your case but use Paradigm's wording. State again that you are not responsible for this fine and they can take you to Court if they wish, where you are prepared to swear on oath that you DID send the DVLA the V5 in good time.

    Didn't I provide a link earlier in the thread to a case where that exact same thing happened? The judge just wanted to hear that the motorist HAD sent the form off, and the case was then dismissed. That's the stage you need to get to, you may need to show up briefly to tell a judge your side and then you win.

    Anyhoo, do a formal letter of reply using the wording copied & pasted from paradigm's post.

    Don't deal with this over the phone, keep a copy of all letters to show the judge that you've already told the DVLA all of this - and if you do have to show up in Court then put in a request of the judge to order payment of your costs (work out beforehand how much this hassle has cost you, as well as the travel to Court etc).
