DELL TERMS&CONDITIONS PLZ HELP

HI GUYS,

I PLACED AN ORDER WITH DELL FOR NEW PDA BUT LATER (IN AN HOUR) FINDS OUT I CAN BUY IT CHEAPER ELSE WHERE. SENT THEM AND E-MAIL ASKING THEM TO CANCEL THE ORDER AND DO NOT PROCESS BUT RECIEVED FOLLOWING EMAIL AFTER MORE THEN 24HOURS, WHEN THEY DESPACHED THE ORDER.

This order has been purchased under our Business Channel and does not constitute a return for refund for any reason in accordance with Dell's Terms and Conditions of Sale and Service.

We are sorry that we could not help you on this ccasion.

As per our Records your order has now been Invoiced -this means the order has shipped from the Factory and is either on route to your Local Depot in the UK or on Route to the Customer.

Please note that from the date of shipping an order can take an estimated 2-3 days to be delivered.

    I am wondering if the Distance Selling Act still applies here.

    If it does and you have contacted Dell directly informing them that yiou have chnaged your mind BUT if they tehn send the goods you will either refuse delivery or send the goods back under the Distance Selling ACT.

    Even though companies have terms and conditiosn in some cases they dont override the law.

    You could check your local Trading Standrads on Monday give them a ring.

    Distance selling regulations - cancellation periods
    The regulations give consumers an unconditional right to cancel an order. This is to allow the consumer the opportunity to examine the goods or consider the nature of a service.

    If a consumer cancels an order, written notice must be given to you by:

    goods – seven working days from the day after that on which the goods are received by the consumer
    services – seven working days from the day after that on which the consumer agrees to go ahead with the contract


    I would suggest you look into this once more and sort it out, or I need to look into further legal advice.
