Your situation will be even more crap if you don't protect your tenant's deposit pronto before they discover you should have done it within days of receiving it. Courts have been known to take a very dim view of such actions and have the power to fine you for THREE TIMES the deposit amount. Maybe your tenants have already been on this site and received that information from our posters0

they already know which is what we are dreading as we know what can happen and so do they and beleive me they are guna sue us i know it coz that's the type of people they are.0

Well stop prevaricating and put the deposit in a scheme. It's really not hard.....
Then you can relax and start the eviction process.0 -

Even if they do sue you, it will look better if the deposit was protected. Did you read the above point about S21 not being valid if deposit not protected, too.
Either you go through the minor hassle of protecting the deposit now (I'm assuming you have the funds to hand) or you risk much, much more hassle in future.0 -
i have just protected the deposit, it would only let me do it from todays date and not go back to when we did receive it andi cant ring them till monday will this be ok?0

you cannot back date your deposit... you have broken the law and may now face the consequences of doing so.....
you clearly have no idea whatsoever about what to do
either ... join national landlords association adn get their legal help line advice as to what to do
or
pay a solicitor
either way its gonna cost you -- dont go into a business you dont know anything about
