Can an ebay seller impose a minimum quantity

My partner bid and won and item via an EBay listing. However we have been sent a message stating that there is a minimum order quantity of 2. I have checked the listing and it does warn of this but my partner missed it. Are sellers allowed to make such criteria please? The seller has stated that if I do not agree and pay for 2 then he will refund my winning bid for one. Is this not fee avoidance as only pays one listing fee but sells two? Thank you

What is the item? I imagine that if he's selling CDs then it's a bit off, but if it's bookends then no one's going to want the spare one.

Not strictly speaking, as that is how the multiple item BIN format works - pay one insertion fee, but multiple final value fees from one listing as each item sells through.

It does seem a curious strategy though - why bother creating hassle and misunderstanding when it is easier to list items in pairs from the outset at a higher price? There could be slightly less to pay in seller fees as well.

How does the seller expect you to pay for the extra item? Purchasing another via ebay, or simply sending the money as a paypal transfer?

You bid and you win, the seller can't start adding extras after the auction ends. Make sure you pay for the one you have bought so seller can't do an NPB on you, and then depending on what he does next consider your feedback carefully.

    Thank you
The item was a USB lead and I have paid but his last message stated he would automatically issue refund after 48 hours if I had not arranged to raise my order to two. I am not sure how I would pay for the second one and do not really want two anyway. It is my partners fault for not reading the listing but just a bit unsure of how to proceed.

Thank you all for your opinions and obviously not bookends other wise would expect to purchase both!!!

If you don't want two, then don't buy two. Take the refund and buy elsewhere.

I agree totally, just remember not to agree to a mutual cancellation and consider your feedback very carefully.

  • I would agree with the above, take the refund but I would leave neg/ neutral feedback stating seller insists on a minimum order more to warn any future buyers.

Accept the refund, neg him then report him to ebay for fee avoidance.

Not fee avoidance is it? If you bought two and paid more, wouldn't fees be higher?

OP when you have your refund, enjoy leaving feedback and stars!
