The glorious "Administration Fee"

Trying to keep this as short and as sweet as possible.
My Brother was showing interest in a property rental and went along to the Estate agents with all the documentaion ie ID and completed signed forms and dropped them into the agency.
On the form it had my Mothers details saying that she will stand as gaurantor (all her name and address details were on the form **But did not have her signiture on there***
My Mum paid the agency the £65 admin fee for my Brother (I know it doesn't matter who paid it) but to be told the day after, as my Mum is not going to be a homeowner much longer she cannot stand as gaurantor, therefore the application has been declined unless another can be sought.
Now I understand that the AF is usually Non-Refundable however, as the paperwork was not complete ie Mums signiture was not on the paperwork, surely this makes the application incomplete therefore not legally binding and should it not have been down to the agency to check this first of all before taking it from my Brother?
As I am trying to get this fee back for them (as £65 is a lot of money just to be throwing away, at the drop of a hat)
any ideas?

Well surely they spent some time administering the forms which is what the fee, at least in part, covers?0

They've done some admin, you have to pay an admin fee, simple.
BTW its signature and guarantor.
