bankruptcy/ cc reclaiming?

Hi guys.
Have posted similar question to this in various places but unfortunately obviously not the right places:). Can anyone tell me if there is any difference in reclaiming credit card charges even though i was made bankrupt in 2006, ie is it possible to do this. i have already started the process but am wondering if i can as obviously the cards were not paid off due to the bankruptcy. all help gratefully recieved:)

  • hi thanks for the prompt reply. i thought i read on one of the forums, some time ago, that someone had done this? not even the fact that the charges kept us in the spirral of debt which we were ultimately unable to get out of??
  • And we had charges dating back a year or 2 before the bankruptcy while we were stil making payments to the various cards? what would happen if we were to pursue these claims?
  • Anything INCLUDED in the bankruptcy cannot be reclaimed, anything EXCLUDED can be. If you reclaim anything then the money goes to the OR to go to your creditors.

  • Sorry, not meaning to doubt your expertise just looking for total clarification. i was dishcharged within a year of of being bankrupt,(discharged in 2007) and therefore have no creditors any more as such, and OR has said any windfall now would not be taken into account??

    See post 2 which I stand by. Furthermore, any charges you claim could be offset against any monies written off since they wrote them off on the acceptance by you of the legality of the bankruptcy. Sorry but after you have been made bankrupt, regardless of being discharged, anything included in the bankruptcy is in all likelihood a waste of your time and energy.

    Hi an update on my query.
    have just received 2 cheques 1 for £416 and 1 for £390. these were for the difference between their £25 charge at the time and the £12 recomended by oft. finally some good news and heres hoping that several others will pay up to.

    You will have to report those payments to the OR, as those are monies from prior to your bancruptcy.

    Nattie is right in the opinions given you should technically offer this money up to your creditors however if they're dumb enuff yo send it then bank it and keep schtum
