Playstation 3

I have had my PS3 for about 1 year and 5 months, it has been playing up for a couple of months now and i have tried everything to solve it, including accessing Playstation tech support who couldnt solve the problems. I still have the receipt for it and am taking it back to the shop today. it cost £300, and i am going to stress the fit for purpose line with the shop, only thing is the shop is HMV so i they'll probably try and hide behind their one year returns policy. Any pointers on how to deal with this. I dont want my money back, all i want is my PS3 to work the way it should.

What do you mean by playing up?

a series of problems, the controllers won't initialise, it won't pick up my wireless broadband anymore even though it had done in the past, so i cant utilise any of the online functions or the internet, and the rest of my wireless devices read it no problem, also it won't read any video content from external drives, it recognises the drive but not the content, and that goes for a variety of different video formats.

by the way i hope the dumb reference is not directed towards me if so please explain !!

 Well subsequent to my previous e-mail, visited HMV with my faulty PS3, receipt in hand, explianed the situation to the guy on the till who in turn spoke to the manager, needless to say they took the company line,
"we give you one year's cover after which you have to refer to the manufacturer".

i outlined that the contract for the goods regarding the sale was not with the maunfacturer and that it was instead with the retailer, and irrespective of any stipulation they place on their responsibility (ie the 1 year) i should still address my problems to them.

i also outlined that under the sale of goods act 1979 the PS3 bought should have been fit for purpose, sold as described, and last a reasonable length of time. my submission was that this was patently not the case. However, the individuals i was speaking to stuck rigidly to the notion that they had discharged the responsibilty for consumer rights with their oen year policy.:mad::mad:

any thoughts on next move please

Maybe contact Sony and ask them to fix it or exchange it, or even better go get a xbox 360, they better than PS3's :D

HMV will argue till you walk away, if Sony will exchange it they should give you a code number to take to the HMV store with your PS3 and you will get a exchange straight away when HMV confirm it with them, that is what happened with my xbox 360, i don't know if Sony are the same as Microsoft though on exchanges like this.

Good luck, let me know how you get on.

    Talk about wrong way round....

Also, one tip on a fault you mentioned: if you're having problems accessing videos from an external drive using DLNA, try rescanning the folders. Sometimes works. But mine never works :D

If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.

Yeah thanks for the reply, have already been onto Sony, they say that because its more than a year old they would replace but they would charge £130, i have e-mailed HMV with my complaint because I can't get a reply form their customer helpline

If you are spouting SOGA then you would know that yes HMV are wrong in what they say however as it has passed 6 months it is down to you to prove there is an inherent fault with the product (ie an independant test). Once you have done this you can then go about asking for it to be solved (they can choose to either refund/replace/repair, not you)
    Always ask ACAS
