Paypal dispute problem

Hi all, I am posting to seek some advice.

I have an ebay account with 100% positive feedback as a buyer and a seller.

I recently sold Fifa 10 on the xbox 360 for £22 with free delivery. The buyer paid fairly quickly so i left positive feedback. However, the buyer asked if i could make a slight amendment to the postal address. I checked the road name and postcode were the same as his paypal address and agreed to the slight change. He said it was a surprise present for his brother so wanted me to put "Yale College Student" in the address.

Early on the 1st February, my wife went to post the item. Later that day, the buyer emailed and said he had forgotten to put his house number but that it was his fault and i should not worry.

However, the buyer decided to open a dispute as he claims the item has not arrived. I provided proof of postage to him and reminded him that he had accepted responsibility for the problem. However, he escalated the dispute to a claim and paypal have awarded in his favour.

Therefore, i am now being told by paypal that i must refund the buyer. I refuse to do this as i feel hard done by. Ebay have also charged me over £2 for selling the game. I explained to ebay what had happened and they say i must cancel the transaction. Imho, the transaction has not been cancelled. The buyer paid, i sent, he disputed, got his money back but i dont get the game back.

I now am faced with not using either ebay or paypal again and the buyer leaving negative feedback.

I dont understand how paypal can award in the buyers favour when the seller has proof of postage and 100% feedback. I am not a powerseller, i am just a man lol!

Any advice would be greatly recieved.

    proof of postage isn't proof of delivery. Paypal terms and conditions you need to provide proof of delivery. You could try and Use your proof of posting to claim via royal mail.

    Its the sellers responsibility to get the item to the buyer and if a dspute is opened you have to prove this
    What proof will eBay accept from me when buyers claim their item was not received?

    We require proof of delivery. You will need online documentation from a postal company that includes all of the following:

    A status of “delivered” (or equivalent) and the date of delivery.

    The recipient’s address, showing at least the city/county or postcode (or international equivalent).

    Signature Confirmation for transactions that total £150 or more.

  • hi, unfortunately you are stuffed with paypal, as you do not have proof of delivery. I have heard that proof of postage is accepted (sometimes with a fight) from paypal, but as you amended the address then you will have compromised the seller protection anyway.

    The item should have fit through a letterbox, so not likely to be at the delivery office, if you put Yale College Student in the address did you put a persons name as well? - the reason is that if it has no name, and no house number then as long as it has your return address on the outside then you may get thsi back from Royal Mail as undeliverable. - if you added Yale College to the persons name, then a postie may recognise the name even without a house number and deliver it (depending on how big the street is)

    Failing it being returned by Royal Mail then you will need to claim for the lost post, as you are not a business you will be able to claim the cost up to £34 (I think £34 is right) from Royal Mail, so you need to get a P58 (I think thats the code for lost post) form, and complete, you will need to include teh ebay sales page and paypal payment as proof of price so that you dont get fobbed off with 1st class stamps, as well as your proof of postage

    The only time proof of postage is accepted is in fraudulent use of a credit card.
