voluntary termination
i wrote to the finance company (Santander) in january using the debtline template, which they got before next payment was due. they then sent own form to be filled in which i had to complete and send back with registration document, i have done this. it has now been a few weeks and i have not heard from them. can they leave vehicle as long as the want? do i need to keep making payments? i am in arrears for 1 payment at the moment this became due after letter was sent do i need to pay this and can they place default on account and refuse vt now? first mot and insurance due 22/2/10 commercial van so not cheap. any help appreciated thx

The date of vt will be the date they received your letter to vt regardless of what was completed after that date.
You are liable for any payment due before the vt date so if a payment was due before the date they received your vt letter then you should pay it otherwise your credit record may show a 1 down prior to vt. Also, they will ask you for that payment in due course if you do not pay now.
You need to ring them and ask why the delay and you could say that you are charging them storage at say £25 per day - that might get them moving.
They cannot refuse the vt providing you have paid half the hp price and are up to date with your monthly payments.0 -
finally got a letter from them today dated the 5/2 asking for mot certificate is still under warranty so phoned them. Said i should take delay in recieving letter up with royal mail, they are demanding vehicle has at least 1 months mot, first mot not due til 22/2 which is when insurance runs out (almost 1k) which i can not afford. They also want last 2 payments which became due after they got letter saying i wanted to vt which is almost £800, the van has a couple of bumps which they could send me bill for. this is all money due to change in circumstances i just do not have. at the moment i just do not know what to do for the best, have appointment to discuss DAS for other debts.0
