NIHE LHA Query

Just a quick question, my partner and I are currently in private rental and we get LHA from NIHE, we are moving out on 1st March into a property that my father owns and I was just wondering if we are still entitled to LHA? The house is empty as he now lives with his partner. He is thinking about putting the house on the market so this is only a short term lease. Does anyone know if we would still get the LHA?

    The council may deem it to be a contrived tenancy and not pay, they may be absolutely fine. In order to become a legitimate landlord your father will need to get consent to lease from his lender, landlord's insurance, supply you with a minimum six month AST, lodge your deposit in one of the three schemes, get a gas safety certificate, be willing to evict you for non payment of rent.

  • Thanks very much for your help, Its not a long term lease as I said, its just at the minute both my partner and I found ourselves made redundant from work, and its only a short term stay until we are back up on our feet again. I'm hoping to only stay there for less than 2 months. Would he still need to go through all what you mentioned for something so short term, especially as he is considering putting the house on the market anyway?
