Swiftcover not paying out on claim help

I bought a mr2 roadster for £4000 and crashed it last month the car is a total right off, no one else was involved just myself. Swiftcover were insuring the car fully comp. They have now told me the car was a CAT D in 2008 I was unaware of this. They now say they are canceling my policy and are not paying out. please please is there someone out there that no's what i should now ????????????????????? :mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad::mad:

    I believe it is something you have to declare when you take out the insurance but if you didn't know, it doesn't make a difference.
    Unfortunately, you can get checks done for this sort of thing for not a lot of money.
    I think you will probably have to put this down as a life lesson and remember to check for this next time!

    14. vehicles previously "written-off" and then repaired

    "Most buyers are (rightly or wrongly) put off by the knowledge that a vehicle was previously "written-off", no matter how well it was later repaired – and this can affect its value.
    If the policyholder knew the vehicle was a repaired write-off, he/she is likely to have paid less for it. So we are likely to decide that it is not unfair for the insurer to make an appropriate deduction – not more than 20%, unless the insurer can provide good independent evidence for a higher deduction.
    But if we are satisfied that the policyholder innocently bought (and insured) the vehicle in complete ignorance of its history, and the repairs were not obviously noticeable, he/she is likely to have paid full price (and a full insurance premium) for it. So we are likely to decide that it would be unfair for the insurer to pay less than the full market value."

    The OP needs to ask them on what grounds they are refusing to pay.

    They cannot refuse to pay out without a good reason.

    Are we getting the full picture from the OP?
  • Well since his cover has never been worth the paper it is printed on then he should get a complete refund... How can they charge him multiple years for protecting his car when in reality there was no protection in place at all?

    At the very least he should get the difference between 3rd party and full comp' back.

    Firstly the OP needs to exhaust Swiftcovers complaint process in full first of all before he involves the ombudsman.

    Could the OP confirm whether he knew that it was a Cat D write off?

    I see 2 outcomes

    1) He didnt know, convinces swfit/ombudsman of this and gets a full pay out
    2) He did know and we are looking at fraudulent misrepresentation hence they may not pay out.

    I would have to suggest 2 is more likely as I doubt swift would refuse to pay out simply because it was a Cat D.
  • Thank you so much for your help epninety, contacted SWIFTCOVER today, told them I am getting the Financial Ombudsman involved. They have done a complete turn around. They have made an offer of £3900 pay off. I am so so happy. Would advice everyone to get a full HISTORY CHECK on a car before buying many thanks
