reclaiming insurance from credit card

Hi, I'm not sure this is in the correct section or not, just to explain
Got a First Direct Gold card in 2002, now things were good and I know its stupid but I don't really look at credit card bills, just pay them via DD, well since times have a changed and are not so good I've been checking a bit.
FD put an employment, sickness insurance on my card from beginning, I never asked for it and I'm 100% sure on this as I had my own business and deffo didn't need anything like that. I don't believe in insurance like that tbh.
Anyway, I finally ring up to ask what this payment is and they tell me its this insurance, I ask why have they been taking it for years and they said it was on the initial form, after a few mins I finally get her to say the box was probably ticked by somebody at FD but I'd signed the form with the box ticked, fair enough so I asked what it covered, unemployment came up, guess what, I've been unemployed for 12 of the last 18 months (builder) plus a few spells in 2003,2005.
So, I ask for a couple of claim forms, and that is where I am now, should I just claim for my unemployment or go for the mis sold
There's another problem, now FD have been taking minimum payment, which on 3k + can be a tidy sum each month, the cover pays 10% of balance per month, now if I claim will they repay my min payment, because if I knew I had this insurance, this payment wouldn't of been payed, and the balance would of come down significantly anyway.
It all proves I had no idea I had this insurance (having never claimed on it) but I don't want things to drag out, any advice???

The first thing you need to find out is whether your insurance covers you when you were self-employed.
I would have thought the answer is probably no (simply because a self employed person can become unemployed at any time of their own choosing).
You would probably be better off making a claim.
So I would claim and if they say you can't thn you have evidence of mis-selling and can go doen that route.now if I claim will they repay my min payment, because if I knew I had this insurance, this payment wouldn't of been payed, and the balance would of come down significantly anyway.
It's your responsibility to KNOW you had the insurance and CLAIM from it.
They almost certainly did provde you with information that you could have read.
It's not their responsibility to claim for you.
So it's not their fault you didn't claim.
I don't know how they will calculate it to be honest, but I don't see why they would accept responsibility for your lateness in claiming.0
