Black Horse - next stage?

Hi,
I have been a long time lurker on this forum and some of the advice I have read here has been brilliant. :T I hope someone can assist me.
I contacted Black Horse in October 2009 to try and reclaim £4000 PPI from a loan of £20,000 (paid in full). I downloaded and used Letter 1 template from this website. By the beginning of November 2009 I received a letter from Black Horse rejecting my claim. They also stated that because I got the loan in July 2003 (mis-sold, I was told that I had to get PPI to get the loan) the Financial Ombudsman would not be able to assist.
Unfortunately, I then became ill and wasn't able to respond to them immediately. I am now well on the road to recovery and have started to compile my second letter using the Letter 2 template from this website.
Am I right to think that there have been changes from the FOS/FLA regarding organisations that were not members before 2005?
I am respectfully requesting advice and assistance with what to write as a reply and to support my claim.

Hi and welcome.
If they were not governed as such by GISC where the FSA taken over Jan 2005, then the FOS are unable to investigate, but what another direction to go in this case is write to the insurer, you should find the details of these on your policy, if not ask BH to provide them to you and write to these the way you did with BH, the FOS should be able to investigate this as they would have been regulated, and also the FOS are trying to make the insurer/underwriters responsible too.
So do not give up quite yet.
