Bank Charges vs CC charges

I may have missed something somewhere, but I had my bank charges (around £850) declined by HSBC due to the court (slap in the face) ruling. Fortunately I do not qualify as in 'hardship', but I'm confused why the banks have got off the hook when CC card companies are still paying out.
In one week with HSBC I was charged £125 for going a few quid over the £50 buffer zone. They did not contact me about this, except for a letter with my statement explaining the charge was £25 per day for the maximum 5 days. How the <insert expletive> can that be classed as "fair"?

Please don't get me wrong - I think its great that people are getting cc charges back still, and the banks are paying out for those in hardship. I just think the court ruling stinks.
