Help Needed - Faulty Exercise Equipment

I am so angry!!

To cut a long story short, my mum ordered a treadmill off an online company, when it came it was missing some essential screws and the computer part of it was damaged. It couldn't be assembled and we rang them the next day, they said they would collect it back and a refund would be issued within 6 days.

The item was taken back but today they have rang us to say we can't have a refund because they assembled the product when they got it back and it was fine.
I rang them myself, I spoke to two people and received ridiculous information. The first lady said it had been damaged by the courier during the return, that it had been used (it had not, we couldn't assemble it properly). Then she finally said that it could work with one screw missing and I quote "You don't need two".!! This was the large screw off the main frame, for an item where you could really hurt yourself if it wasn't stable.
Then I spoke to the manager who said the item was perfect when they got it back and basically accused me of lying and totally contradicted what the other lady had said. Me and my sister tried to assemble this machine, there were three of us in the room. We all saw the bits missing and damaged.

It seems obvious to me that they have replaced all the missing bits and are trying to pretend it was us (well at least the manager is, the first lady said three seperate things completely different to that!).

Also, the first lady who was really aggressive with my mum told her they were simply going to re-send the treadmill out to her (which I have told her to refuse delivery of, I hope that is right).

This all happened within 7 days by the way, from receipt to return. They said that makes no difference!!!

Please help, my mum can't afford to have £100.00 thrown away. What are my options here?

  • Tell them that it was rejected because it was faulty and/or in the alternative, pursuant to the Distance Selling Regulations.

    Either way, you want your money back.
