A Private Buyer

Hi All,

Our house in on the market with an estate agent who we have a sole-agent agreement with for 12 weeks.

Some friends of my wife are going to view our property without going through this agent.

What would be the situation if they wanted to put an offer on our house.

The only clause I can see is if you cancel the agreement with the estate agent within 7 days.

Can anybody enlighten me?

  • Yes you need to study the contract but usually Sole Agent means just that and you could sell privately. But it may be worth asking the EA how much they would charge to see the sale through for you.

    Just make sure the contract does not say Sole Selling Rights which means you would have to pay the EA anyway.

    Read the contract to determine which it is.

    How did the friends find out you were for sale? Honestly, did they find out when the agent's sale board went up, or when it went on their website, or in their window? If so, wouldn't you say you have at least a moral obligation to pay them their fee....?

    They had not seen the for sale sign.

    My wife spoke to them regarding a different topic entirely and then my wife mentioned we were moving.

    I guess that morally we have an obligation but I just wondered what other options we had.
  • I have double checked. It is sole-agent not sole selling rights.
