Hi,
I hope this is in the right place.
I purchased a laptop from dell on the 26th of January 2010 and paid £2629.
I paid on my Visa Debit card, not a credit card.
I looked at my bank statement I could see my cleared balance was minus the total amount pf the laptop. Then a few days later my balance was back to the full aamount.
I let a few days pass and did not hear anything from Dell or the bank. As the days went on I assumed there had been a mistake with the order and and left it at that, then I thought I could re-invest the money elsewhere in the business, and make do with the laptop I have.
Now today the 16th of February the laptop has turned up and I am £2300 overdrawn!!
Is this legal? I do not have an overdraft and a Visa Debit card not a credit card. Can the banks just autherise a payment of that amount?
I mean they would not even lend me £2629 if I begged!!

Don't know about the technical side of this but just a thought - when you placed the order did it say that they money would only be debited from your account when the laptop was sent? did it indicate there would be a waiting time for the laptop?
I would assume you can return the goods under the distance selling rules and get a refund but hopefully someone more knowledgable will confirm/advise.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
What kind of laptop costs £2629?
You ordered a laptop and you now have a laptop - if you did not cancel the order and get a cancellation notice from Dell of course they can get money from your bank account.0 -
They pre-authed your card for the full amount to make sure it was available before sending the order to the factory. As it was just a pre-auth the amount was made available again three working days later.
Once the factory had built the laptop and it was ready to ship, they took the amount as a "proper" transaction (not just a pre-auth)... you authorised it, they took it, so there's not a great deal that can be done other than reject the parcel when it arrives and you'll get a refund.

You knowingly spent money that you didn't have and you didn't use your head by checking with Dell or your bank.
If this is a business laptop Dell may not take it back0 -

When you say 're-invest', are you able to get that money back.
On the whole, I agree with everyone else. You'd knowingly spent the money so you should have accounted for it in your cashflow, in the same way you would account for a cheque you've written that hasn't cleared yet.

Something similar happened to me, except they never charged me at all.
Got a letter 2 days ago asking me for the money claiming a computer glitch - a year and a half later haha.
My laptop was £500 though0 -
