Tenants faking problems to get out of paying rent

I know the usual complaints are that LLs are the baddies, but we have the opposite problem in that our tenants are making spurious complaints to get compensation.

They have even called in the council to complain about damp! The counil did visit and said there was nothing wrong.

The tenants have now sent pictures of damaged property! Laughable really, but disappointing after we have bent over backwards to help them over the time they have been with us.

They were 27 days late with last months rent. This month's is due soon and I expect them to be late with it, but have put it in the hands of our solicitor.

Any advice please?

  • If the bods from the Council have confirmed there's no damp problem then any damage has probably been caused by condensation of their own making. I'd have a word with your tenants and try to impress on them the necessity to ventilate and heat adequately. Suggest they buy a dehumidifier. You have absolutely no obligation to offer them compensation under the circumstances and they cannot use this to justify withholding rent or to pay it late.

    Warn them that paying rent late is not acceptable and if they continue to do so you will consider charging them interest.

    What length of tenancy agreement do these tenants have and when does it end?
  • Thanks for the reply. Two months to go! Interest seems a good way to go - or at least to use as leverage to get them to pay.

  • To be on the safe side, to prevent spurious complaints at a later date I would put this all in writing to them and keep a copy for future reference. These sound like the type of folks who would withhold the last couple of months rent so you've no funds to cover damage or replacement items on check-out from the deposit
  • If you haven't already, then get a S.21 notice out to them PDQ.
