I have an elderly neighbor who part owns a piece of land(I am the other part owner) down the side of my property.
I have made him very good offers over the years to purchase his part of this land, but as he used to use it occasionally for walking access (he also has main road access to the front of his property), I did say he would still have unlimited access until he no longer needed it.
He said he would bare the offers in mind, but it never got any further.
He has now suffered a severe stroke and is confined to his bed(he is approaching 90 ).
I was debating whether to go and see him to talk about it, but have now found out that a high street bank are the proprietors?
I am concerned. I am not getting any younger and I do not relish the thought of cars /motorbikes etc being driven up the side of my (up 'till now very peaceful and tranquil property) when the neighbors property is sold.
What would you do as a next step??? and a follow on.
P.S
There was a charge put on his property in 2005 from a b/s with monies to be drawn down as needed.
In 2007, the b/s was taken over by a bank.
The land registry now list the bank as the proprietor??
I would be most grateful for any information on a way forward for myself.

Many Thanks in advance
I am a LandLord,(under review) so there!:p

Are you sure you are a joint owner with this man? I don't see how you can be if a bank owns it. Have you got a copy of the Land Registry Title Register? If so, who is listed in Part A as the propriator?

Are you sure you are a part owner, not just a person with rights over the land? Or maybe you're a joint owner and you gave the bank a mortgage over the land?

It is possible to be an owner if you are not on the title registers, if you are a beneficial owner (but I think you'd know if you were, it's pretty specialised)

Sorry not to help immediatly, I need more info first.

    Many Thanks for your reply.
Not sure what you want to know?
I to read this through again as looking at it now, it reads
" I have right of way at all times to pass and repass in, over and along the said piece of land coloured blue on the said plan."

I think we need to talk privately on a paying basis.
I will consult my wife this evening.
    Many Thanks

If he's had a severe stroke does he have the mental capacity to sell land? If it really is jointly owned that is.

Can you get a sight of his deeds from the Land Registry? What does it say on your own deeds?

Sounds like they own a bit each.

Fairly normal the land between two houses, each house owns a bit.
