been brushed off by rbs for ppi reclaim

Hello there,
Im a newbie here so apologies for any faux pas. Bascially about 18 months ago i wrote a letter to rbs in regards to ppi on a loan that my partner had. The loan was settled in 2006. She took the loan out through Sainsburys and the lender was rbs.
In the original letter she stated that she believed the ppi had been missold due to being informed she had to have the ppi in order to get the loan. About 2 months later she recieved a letter basically saying that no we feel that it was fair etc and basically go way. Due to other events in our lives at the time first child etc we didnt fight it and let it slide.
We currently have no paperwork for the loan and the questions i would like to ask are
1 Can we start the process again.
2 would we just need to ring rbs and ask for loan account details
3 assuming we get the same response would we just follow the advice on here in terms of taking the next step letter before action etc
thanks in advance for anybody who can help.

You can have a go at starting again but there would be no promises that the firm would write back if they already gave their final response.Hello there,

You can just ring them but it may be better to ask in a letter.
The last one is difficult as they could state they gave their final response some time ago but I suppose its worth a shot.

Regarding your queery, did you contact the rbs after receiving the letter to question it, or do you think you could play their game and state that as it has been a while now and you have NOT heard from them since you 1st requested the refund of the PPI on the redeemed loan,;) you are to take it the RBS has misplaced the requested refund and start the request again.:D They may state the obvious that they contacted you and did not hear from you etc, to which you could argue the point that you 'Did not receive a reply to your request':cool:
You may want to word it like:
'Dear sir/madam,
It has come to my attention that I wrote to you back in (whenever) regarding a loan for £s which I redeemed with you on/ around and the subsequent claim for mis sold PPI on the same loan. I have come to realise that to date I have not received any correspondence since my letter of (rough date sent) regarding my claim for a total refund.
I would be grateful if you could look into this and respond with your findings asap so I will know wether to persue the matter further with the FOS or accept your offer of a total refund to date. etc.':D
You may want to word it differently, but if you play it as if you have no record of any response from them, then you should be able to restart your claim via the FOS as you can always tell the FOS you have never received their correspondence. Remember, should the FOS rule in your favor, they have to recalculate the loan as if it was taken out without PPI so the redemption figure will also have been overpaid so theres even some of that to come backas well plus the statutary 8% interest they have to pay you from the redemption date to the settlement date (if you are successful of course):eek:
ps I am no legal eagle so its only what I would do if I was in your position, Like you say, its your money theyve wngled out of you, so you should be able to get it back.:A

Hi there. Yes you still can claim. I would say your best bet would be to ask for a recording of the call (i assume it was done over the phone?) This would give you all the ammo you would need to shoot them down!!!0
