'Soiled' Trainers bought of eBay - Problem!

I bid and won and instantly paid via PAYPAL for a pair of NEW Nike trainers for my husband.

Received the trainers a few days ago, but the stitching is loose in parts, a few stains, a few marks here and there - I could nt give these as a present to my hubby!

I contacted the buyer immediately - who said return them; they will inspect; and decide.

I won them for £30 plus £10 P&P. They will give me a refund (of only £30 - not the p&p) - that would mean £18 spent and no trainers recvd.

But they wont exchange - I dont want to spend another £8 to return them (and lose the prv £10 p&p paid)

I've PMd them for an exchange - they just wont agree.

What do you folks suggest? I have the trainers - they have my money. Can I launch some dispute via Paypal???

Since I have bought - others have left similar feedback (Stained trainers etc etc etc)

  • Just claim from paypal as not described.Btw i bet soon as you do he'll be more helpful.
  • Did they actually say they were new (without any menntion of imperfections) in the description, or was it just in item specifics? If the latter, it's just about possible it may be a genuine mistake: the slightest accidental touch of a mouse wheel can sometimes cause scrolling to completely the wrong option, which may then go unnoticed. However, if the seller is asking to inspect the trainers before deciding whether a refund is due, that sounds really iffy. I would offer to e-mail them photos of the problems, and if they still won't play nice, start a Paypal dispute.

They are advertised as BRAND NEW - not seconds or soiled or stained etc.

How do I start a Paypal dispute? Never needed to before. And what does it entail?

a lot of the catalogues ie Kays, empires etc have had massive sails on recently, I have just bought myself a new pr of Nikes for £19.99, and dh a pair for £55 that were £100, prev to this, I ordered some from empire for £25 reduced from £75, so there is a good chance they were genuine (if I paid £20 and sold them for £30 a pair, I'd be happy with that profit)

What did the stains look like? Did they seem like stains of a used item, like mud for example, on the sole, or cosmetic damage? Perhaps there was damage in the post, did you see any damage on the item when buying? If the damage was due to sending, you'd need to start a dispute with the company who sent them to you, e.g Royal Mail or Parcel force etc.

If you feel that the item was damaged due to useage, and the seller isn't doing anything, try and claim from Paypal, or start a dispute via Paypal or Ebay, perhaps tell Ebay about this and get them to help you.

They are new trainers - with a couple of small (but visible stains) and loose stiching.

I bet if you return the trainers the seller will proberly say that you have worn them. I think its a waste of time involving Ebay, at the end of the day Ebay will get hundreds of complaints each day and they just ignore them. Its a bummer but you will spend more time and money trying to get a positive outcome. At the end of the day even negging the seller is a waste of time, i would get your hubby and his mates to pay the seller a visit, that is the only way to get your refund.
All the big powers they've silenced me. So much for free speech and choice on this fundamental human right, and outing the liars.

Paying the seller a visit is not the answer and is not the only way. Starting a paypal dispute is. You will be required to return the item to the seller when paypal instruct you to.(make sure you send them recorded, this will be the only cost to you) and paypal will take the cost of the item and the original postage from the seller and refund you. Easy as that.
