Has anyone had replies from the new templates?

Are we still awaiting the first replies from the banks in relation to the new template letters from this site?

  • I have just got a reply in the post today from Nationwide. I was reclaiming charges using the Consumer Credit Act (not human rights) and used the template as in the guide, I recieved this reply
'... In your letter you have requested specific information relating to a Mis-sold Policy in ralation to a flexAccount. Please note, Mortgage and FlexAccounts are not regulated under the CCA'

They have returned my letter, what do I do next?

The Flexaccount (unless there is something weird about it) will be covered by the CCA only when it is in overdrawn situation. Read Coutts v Sebestyen 2005.

(sorry my puters on a wonk and I can copy and paste but if you look on the BAILLI website and search on Coutts you should find the case.) When I fix this damn thing I"ll paste the info for you.

A Mortgage wouldnt be covered, nor would mis-sold policies - you want to keep Charges and PPI etc claims seperate when claiming.
