Faulty laptops

Hello all

Can anyone please give me some advice as to whether it is worth going to the small claims court to seek redress for faulty laptops. myself and my colleague were bought identical laptops for personal use to complete uni course work, they were bought from currys and cost just under £1000. They are identical but within 6 months developed different faults. They were returned to be repaired but the same faults reoccured therefore breaking twice within 8 months. I contacted consumer direct which said we had a load of legislation on our side and talked us through the process of seeking replacements as we didn't want them repaired again. However, currys are really digging their heels in and are refusing to replace or refund us for them and have told us to go to Dell the manufacturer as they carried out the repairs. Consumer direct are suggesting we either back down and go to Dell or sue in the small claims court but suggest we are taking a chance as the court could decide repairing them again is reasonable!! Can anyone please tell me what happens if we go to the small claims court and they side with Currys, will we be left with laptops we cannot use and be left seriously out of pocket as i don't know how much the whole process costs.

    There's a problem straight away. If you did not buy them yourselves, you do not have a contract to enforce with Currys.

    Who bought the laptops for you? If it was a business, then none of the consumer rights legislation will apply. This does not mean that there is nothing that you can do, but it will make things more complicated.
  • oooooh is that why they are not being very co-operative i wonder. They were both bought by the company I work for and given to us as a part of a bonus.

    It's reasonable to let them repair it, you are unlikely to win in court.

    I think it depends on how many times, if the laptops were problematic from the start and repairs are not solving the problem then it could be said that they are unfit for purpose and Currys should either offer a replacement or refund.
